How is the act of dumping garbage into the urban wastewater drainage system punished?

Pursuant to Point d Clause 2 Article 25 Decree 45/2022/ND-CP stipulating penalties for violations of regulations on environmental protection in public places, urban areas, residential areas; transportation of raw materials, materials, goods causing environmental pollution as follows:

1. Warning penalty for the actvinot posting environmental sanitation regulations in public places.

2. OnionviCollecting and discharging waste in violation of environmental protection regulations will be punished as follows:

a) A fine of VND 100,000 to VND 150,000 shall be imposed for the act of throwing, dumping, or discarding cigarette butts, butts, or ashes in the wrong place in apartment buildings, commercial or service areas, or public places;

b) A fine of 150,000 VND to 250,000 VND for personal hygiene (urination, defecation) not in the prescribed place in apartment buildings, commercial areas, service areas or public places;

c) A fine of VND 500,000 to VND 1,000,000 shall be imposed for the act of dumping, discarding, or disposing of garbage or wastewater in the wrong place in apartment buildings, commercial or service areas, or public places, except for the violation specified in Point d of this Clause;

d) A fine of VND 1,000,000 to VND 2,000,000 shall be imposed for the act of dumping, disposing of, or discarding waste on sidewalks, roadsides, or into urban wastewater drainage systems or surface drainage systems; improperly dumping wastewater on sidewalks, roadsides; and disposing of plastic waste generated from daily activities into ponds, lakes, canals, rivers, streams, or seas.

3. Fine from 2,000,000 VND to 4,000,000 VND for the act ofviTransporting raw materials and materials without covering or letting them fall into the environment while participating in traffic.

4. A fine of VND 10,000,000 to VND 15,000,000 shall be imposed for failure to use specialized equipment or vehicles during the transportation of materials or goods, causing leakage or release into the environment.

5. A fine of VND 10,000,000 to VND 20,000,000 shall be imposed on the management of parks, amusement parks, entertainment areas, festivals, tourist areas, markets, train stations, bus stations, wharves, ports, ferry terminals and other public areas that commit one of the following acts:

a) Lack of adequate public toilets, facilities and equipmentthuCollect waste to meet environmental hygiene requirements as prescribed;

b) NothuCollect waste within the prescribed management scope;

c) Không bố trí nhân lực thu gom chất thải, làm vệ sinh môi trường trong phạm vi quản lý; không có cán bộ, tổ hoặc đội bảo vệ môi trường để kiểm tra, giám sát theo quy định.

6. Phạt tiền từ 200.000.000 đồng đến 250.000.000 đồng đối với chủ đầu tư xây dựng khu đô thị, khu dân cư tập trung có hành vi vi phạm về bảo vệ môi trường sau đây:

a) Không có mạng lưới thoát nước mưa, nước thải riêng biệt; không có công trình vệ sinh nơi công cộng đáp ứng yêu cầu về bảo vệ môi trường;

b) Không có hệ thống thu gom, xử lý nước thải đồng bộ, phù hợp với quy hoạch đã được phê duyệt;

c) Không có thiết bị, phương tiện, địa điểm để phân loại tại nguồn, thu gom, lưu giữ chất thải rắn sinh hoạt phù hợp với lượng, loại chất thải phát sinh từ hộ gia đình, cá nhân trong khu dân cư tập trung;

d) Not ensuring green areas, water surfaces, and open spaces in urban areas and concentrated residential areasaccording toregulations.

7. Remedial measures:

a) Forced restoration to the original state; if environmental pollution is caused, measures must be taken to remedy the environmental pollution caused by administrative violations in cases of violations at points c and d, clause 2, clause 3 and clause 4 of this Article;

b) Compulsory construction and installation of environmental protection worksaccording toprescribed within the time limit set by the competent authority in the decision on administrative sanction for violations specified in Points a, b, c, Clause 6 of this Article;

c) Forced to take measures to remedy environmental pollution as prescribed and report the results of the completed remediation of the consequences of the violation within the time limit set by the competent authority in the decision to impose administrative sanctions for violations specified in Clause 5 and Clause 6 of this Article.

Thus, the act of dumping, disposing of, or discarding waste on sidewalks, roads, or into urban wastewater drainage systems is subject to a fine of 1,000,000 VND to 2,000,000 VND, with the fine for organizations being twice that of individuals.
