Nghe An people carry out 46 land procedures regardless of administrative boundaries according to the new decision of the Chairman of the Provincial People's Committee.

Chairman of Nghe An Provincial People's Committee Le Hong Vinh has just signed a decision to promulgate a list of 46 administrative procedures in the land sector that are implemented regardless of administrative boundaries within the province.

Of these, there are 32 provincial-level administrative procedures and 14 commune-level administrative procedures. The implementation aims to facilitate people and organizations in accessing and implementing public services, minimizing costs and travel time.

According to the decision, the Department of Agriculture and Environment is assigned to preside over and coordinate with the Provincial People's Committee Office and relevant agencies to develop and complete internal procedures, electronic procedures, and interconnection procedures for each administrative procedure.

At the same time, organize training and professional guidance for civil servants and public employees at the One-Stop Department at all levels, especially at the commune level, to ensure consistency and efficiency in receiving, processing and returning results.

The People's Committees of communes, wards and towns are responsible for receiving dossiers and returning administrative procedure settlement results to organizations and individuals regardless of the administrative level, administrative boundary of residence, headquarters or previous place of document issuance.

In particular, the head of Nghe An Provincial People's Committee requested: Return administrative procedure settlement results to organizations and individuals at the place where the dossier was received, within the prescribed time limit, without requiring people to move to the competent authority for settlement.

46 ADMINISTRATIVE PROCEDURES IN THE LAND FIELD ARE IMPLEMENTED REGARDLESS OF ADMINISTRATIVE BOUNDARIES WITHIN THE PROVINCIAL LEVEL IN NGHE AN PROVINCE

I. 32 provincial administrative procedures include:

1. First land registration in cases where the State allocates land for management.

2. Cancellation of registration for lease or sublease of land use rights in infrastructure construction and business projects.

3. Registration of changes in cases where a member of a household or individual is using land to establish a private enterprise and uses the land for the enterprise's production and business activities.

4. Register and issue Certificates for land plots with increased area due to boundary changes compared to the issued Certificates.

5. Registration and issuance of Certificates for individuals and households that have been granted Certificates for part of the land area classified as residential land before July 1, 2004, and the remaining area of ​​the land plot has not been granted a Certificate.

6. Issuance and exchange of Certificates of land use rights and ownership of assets attached to land.

7. Land division or consolidation.

8. Re-issuance of Certificate due to loss.

9. Correction of issued Certificate.

10. Revoke the Certificate issued in violation of the provisions of the land law when discovered by the land user or owner of the property attached to the land and reissue the Certificate after revocation.

11. Register and issue a Certificate for cases where land use rights have been transferred before August 1, 2024, and the transferor has been granted a Certificate but has not yet completed the transfer procedures as prescribed.

12. Register and grant Certificates of land use rights and ownership of assets attached to land to transferees of land use rights, ownership of houses and construction works in real estate projects.

Register changes in land use rights and ownership of assets attached to land due to division, separation, consolidation, merger of organizations or conversion of organizational models or types of enterprises according to the provisions of the law on enterprises; adjust detailed construction planning; issue Certificates for each plot of land according to detailed construction planning for project investors in need.

24. Registration of changes in cases of change of land use rights, ownership of assets attached to land according to the agreement of household members or of husband and wife; land use rights to build works on the ground serving the operation, exploitation and use of underground works, ownership of underground works; sale of assets, transfer, assignment of land use rights which are public assets according to the provisions of law on management and use of public assets; receipt of land use rights, ownership of assets attached to land according to the results of settlement of disputes, complaints, denunciations about land or judgments, decisions of the Court, decisions on enforcement of judgments of enforcement agencies that have been enforced; decisions or awards of the Vietnam Commercial Arbitration on settlement of disputes between parties arising from commercial activities related to land; Receive land use rights and ownership of assets attached to land due to the settlement of mortgaged assets which are registered land use rights and assets attached to land, including the settlement of debts originating from bad debts of credit institutions and foreign bank branches.

26. Registration of changes in land use purposes does not require permission from competent state agencies.

27. Registration and issuance of Certificates for households and individuals using land for purposes other than those for which the State recognized land use rights before July 1, 2014.

28. Registration and issuance of Certificates for cases of transfer of investment projects using land.

29. Economic organizations receive transfers, lease land use rights, and receive capital contributions in the form of land use rights to carry out investment projects.

30. Multi-purpose land use, extension of multi-purpose land use plan.

31. Registering assets attached to land plots that have been granted Certificates or registering changes in assets attached to land compared to registered content, extending the home ownership period of foreign organizations and individuals according to the provisions of the law on housing and registered content.

32. Confirmation of continued use of agricultural land.

II. 14 commune-level land administrative procedures include:

1. Redefine the residential land area of ​​households and individuals that were granted a Certificate before July 1, 2004.

2. Correcting errors in the first issued Certificate.

3. Revoke the Certificate that was first issued in violation of the provisions of the land law when discovered by the land user or owner of the property attached to the land and reissue the Certificate after revocation.

4. Registering land and assets attached to land, granting Certificates of land use rights and ownership of assets attached to land for the first time to organizations using land.

5. Land allocation, land lease, and change of land use purpose in cases of land allocation and land lease without auction of land use rights or without bidding to select investors to implement projects using land; cases of land allocation and land lease through bidding to select investors to implement projects using land; land allocation and forest allocation; land lease and forest lease; extension of land use upon expiration of land use term.
