Mr. Duong Sy Linh, residing in Thanh Vinh ward, asked: Currently, what is the penalty for intentionally not putting down the motorbike's kickstand or letting other objects scrape the road surface while driving?

According to Point a, Clause 9, Article 7 of Decree 168/2024/ND-CP of the Government, a fine of 8 - 10 million VND will be imposed on drivers who weave or swerve on the road; use a kickstand or other object to scrape the road while the vehicle is running.

In addition to the above penalties, violators will also have their driving licenses revoked for 10-12 months according to Point b, Clause 12, Article 7, Decree 168.

Compared to the previous regulations in Decree No. 100/2019/ND-CP, the current penalty level has increased significantly. Specifically, previously this behavior was only fined from 2 to 3 million VND and had the driver's license revoked for a period of 2 to 4 months. The adjustment of the penalty level shows the stricter law on behaviors that endanger road traffic order and safety.

In fact, the "not putting down the kickstand" error is only handled when there is an intentional element, often associated with seriously unsafe behaviors such as racing, weaving or intentionally creating noise or sparks on the road. In cases where the driver accidentally forgets to put down the kickstand while participating in traffic, the Traffic Police will remind instead of punishing.

However, people need to raise awareness of self-checking their vehicles before participating in traffic, especially properly putting down the kickstand. This is not only a mandatory requirement to ensure safety for themselves and other road users, but also an act of demonstrating compliance with the law and civic responsibility when participating in traffic.
