Chairman of Nghe An Provincial People's Committee receives citizens at regular session in September 2025

On the morning of September 15, comrade Le Hong Vinh - Deputy Secretary of the Provincial Party Committee, Chairman of the Provincial People's Committee received citizens at the regular session in September 2025. Also attending were representatives of the National Assembly Delegation, the Standing Committee of the Provincial People's Council and related departments, agencies and localities.

Mr. Hoang Ngoc Binh, Thuong Xuan hamlet (former Nam Cat commune), now Kim Lien commune, proposed 2 contents related to granting land use right certificates (LURCs)

The first plot of land in Dam Dia, Dai Thang hamlet (now Thuong Xuan hamlet) had an area of ​​312m2.2In 1988, after being discharged from the army and returning to his locality, Mr. Hoang Ngoc Binh was assigned land by the People's Committee of Nam Cat Commune (old) to build a house and according to the citizen, he paid 500 thousand VND. However, the land allocation minutes clearly stated: If after 1 year the house is not built, it will be reclaimed.

However, after 7 years, Mr. Binh still had not built a house in the above area. Therefore, in 1995, the government granted this land plot to Ms. Nguyen Thi Huong, a relative of a martyr. However, because the land plot was located in a low-lying area with no residents, Ms. Huong did not use this land plot and was granted a different location in 2012. Currently, the above land plot has no assets.

At the same time in 1995, Mr. Hoang Ngoc Binh was granted a land area change at the intersection of Dai Thang hamlet with an area of ​​131m2 by the People's Committee of Nam Cat commune (old).2, now through correction, the exact area is determined to be nearly 119m2, with land allocation minutes dated November 5, 1995.

On this plot of land, Mr. Binh's family built 2 concrete foundations and a 16m2 level 4 house.2and used for drug sales service. However, up to now he has not been granted a land use right certificate.

At the citizen reception session, after listening to Mr. Hoang Ngoc Binh's presentation, leaders of relevant departments, branches and localities analyzed and clarified factors related to his recommendations.

The authorities have reviewed the land allocation process, land plot location, current usage status, as well as legal regulations, to serve as a basis for determining the rights and obligations of citizens and the responsibility of the government in resolving the issue.

Accordingly, regarding the content of the petition to grant a land use right certificate for the 312m2 land plot2Dam Dia area, Thuong Xuan hamlet has no basis for settlement according to legal regulations because Mr. Hoang Ngoc Binh does not use the above land plot.

Regarding the content of the proposal to grant a land use right certificate for 119 m2At the intersection of Dai Thang hamlet, according to the authorities, the land plot was originally assigned by the People's Committee of Nam Cat commune (old) in 1995 without proper authority and the entire area of ​​the land plot is currently located within the traffic corridor of Provincial Road 539C, which is inconsistent with the planning and therefore does not meet the conditions for being granted.

Concluding the citizen reception session, Chairman of the Provincial People's Committee Le Hong Vinh shared with citizens about the case in the past time; at the same time, he affirmed that to resolve it, it is necessary to base on the legal basis and originate from the rights, responsibilities and obligations of both sides: the Government and individual citizens.

The head of the provincial People's Committee stated that during the process of resolving the issue at the grassroots level, there were still some unresolved issues for Mr. Hoang Ngoc Binh's family. However, looking back at the entire incident from 1988 to the present, it can be seen that the local government has created favorable conditions for his family, a family of meritorious people.

Specifically, although the first plot of land was granted in 1988, it was not until 1995 that Mr. Hoang Ngoc Binh had yet to build a house on this plot of land, while according to regulations, if after 1 year the house is not built, it will be reclaimed.

When this plot of land was granted to Mrs. Nguyen Thi Huong's household, the government still proceeded to grant her another plot, currently a plot of land of nearly 119 m² in Dai Thang hamlet (old), adjacent to the traffic axis, convenient for living and production. Granting this second plot of land was beyond its authority but at the same time showed the concern and facilitation of the Nam Cat commune government (old) for his family.

Therefore, for the proposal to grant a land use right certificate for the land plot in Dam Dia, Dai Thang hamlet (now Thuong Xuan hamlet) with an area of ​​312 m2The Chairman of the Provincial People's Committee agreed with the conclusion of the authorities that there was no basis for granting and assigned Kim Lien commune to strictly manage this land plot.

Regarding the 119 m² plot of land at the Dai Thang hamlet intersection (old), during the process of receiving citizens, some new factors appeared that needed to be verified and clarified. Citizens said that there were signs of falsifying the content of the land allocation minutes, changing the purpose from residential land to "land for housing".

The Chairman of the Provincial People's Committee assigned Kim Lien commune to coordinate with the police force within 1.5 months to verify the handwriting, determine whether the purpose of use is "residential land" or "land for plots"; at the same time, clearly determine where the financial obligation of 500,000 VND that Mr. Binh paid was transferred to; clarify the time when the citizen requested to be granted a land use right certificate. Based on the verification results, the competent authorities will have enough grounds to consider the citizen's petition to ensure strictness and compliance with the provisions of law.

Regarding Mr. Hoang Ngoc Binh's proposal that if the conditions for granting a land use right certificate for the nearly 119 m2 plot of land are not met, this plot of land should be reclaimed and compensation should be paid to his family, because it is located within the traffic corridor, the Chairman of the Provincial People's Committee emphasized that compensation will only be made when there is a specific project and valid documents according to the law.
