The Legal Committee of the People's Council of Nghe An province reviewed the draft resolution related to the delegation of authority at the commune level.

Preparing content for the thematic session - the 33rd session, the 18th Provincial People's Council, term 2021 - 2026, on the morning of October 28, the Legal Committee, the Provincial People's Council held a meeting to review the draft of a number of resolutions in the legal field; including the content of authorization at the commune level regarding justice.

Review of authorization regulations at commune level

Reviewing the draft resolution stipulating the scope of tasks and powers authorized by the Chairman of the People's Committee at the commune level to civil servants in the judicial field; the meeting participants agreed on the necessity of issuing a resolution, which is both consistent with newly issued legal regulations and meets the requirements of administrative reform, shortening the process of handling administrative procedures for organizations and individuals.

In addition, some members also commented and added legal basis for issuing the resolution. Regarding the scope of authorization, it is necessary to study and consider some authorization contents suitable to the capacity, ability and conditions of commune-level civil servants. At the same time, it is necessary to supplement the implementation organization, assigning the Chairman of the People's Committee at the commune level to flexibly choose the appropriate authorization content for civil servants on the basis of the authorization groups decided by the Provincial People's Council after the draft resolution is passed.

According to the draft resolution stipulating the scope of tasks and powers authorized by the Chairman of the People's Committee at the commune level to civil servants in the judicial field; there are 4 groups of authorized contents, including:

Certify copies from originals of documents and papers issued or certified by competent agencies and organizations of Vietnam; competent agencies and organizations of foreign countries; competent agencies and organizations of Vietnam in association with competent agencies and organizations of foreign countries.

Certify signatures in documents and papers. Certify documents refusing to receive inheritance. Certify signatures of translators in documents and papers from foreign languages ​​to Vietnamese, from Vietnamese to foreign languages.

The Legal Committee of the Provincial People's Council also conducted an examination and agreed to include in the agenda of the 33rd session. The Provincial People's Council considered and approved the draft resolution amending and supplementing a number of articles of Resolution No. 11/2022/NQ-HDND on civil status fees in Nghe An province and Resolution No. 12/2024/NQ-HDND stipulating the level of expenditure for disseminating and educating the law, standards of legal access and mediation at the grassroots level in Nghe An province.

Specifically, the Provincial People's Committee submitted to amend and supplement Article 2 of Resolution No. 11/2022/NQ-HDND dated July 14, 2022 on civil status fees in Nghe An province related to the collection of civil status registration fees; at the same time, amend and supplement the Appendix issued with Resolution No. 12/2024/NQ-HDND dated July 11, 2024 stipulating the expenditure level for disseminating and educating the law, standards of legal access and mediation at the grassroots level in Nghe An province.

2. Late birth registration, re-registration of birth, birth registration for people with foreign records and personal documents: 70,000 VND.

3. Late death registration, re-registration of death: 10,000 VND.

4. Death registration, re-registration of death with foreign elements: 70,000 VND.

5. Re-registering marriage: 20,000 VND.

6. Marriage registration, re-registration of marriage with foreign elements: 1,300,000 VND

7. Registration for adoption: 20,000 VND.

8. Registration for adoption of father, mother, or child with foreign elements: 1,300,000 VND.

9. Registration of guardianship, termination of guardianship with foreign elements: 70,000 VND.

10. Supplementing household registration for Vietnamese citizens residing in the country: 10,000 VND.

11. Changing and correcting household registration for people aged 16 and over residing in the country; re-identifying ethnicity: VND 25,000.

12. Changing, correcting, and supplementing civil status with foreign elements: 60,000 VND.

13. Issuance of marriage status certificate: 15,000 VND.

14. Recording in the Family Register the family status of Vietnamese citizens that has been resolved at a competent authority of a foreign country: 60,000 VND.

15. Other household registration: 10,000 VND.

16. Civil registration with other foreign elements: 60,000 VND.
