Submit to the National Assembly a draft mechanism and policy to remove difficulties and obstacles in implementing the Land Law

On November 18, in the working program, the Government submitted to the National Assembly a draft Resolution of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law.

The Draft Resolution is structured into 3 Chapters, 13 articles including 3 basic content groups.

First of all, the group of institutional contents on viewpoints, goals, tasks, and solutions according to the Resolution of the Central Executive Committee and the Conclusion of the Politburo, such as: Adding 3 cases where the State reclaims land for socio-economic development for national and public interests; regulations on conditions for land reclaim for national defense, security, socio-economic development for national and public interests; regulations on the basis for land reclaim in cases of land reclaim according to the progress of investment projects or according to the progress of compensation, support, and resettlement, etc.

The second group includes the contents to resolve the "bottlenecks" pointed out in Notice No. 08-TB/BCĐTW of the Central Steering Committee on perfecting institutions and laws such as: Adding cases where the State reclaims land for national defense and security purposes to build drug rehabilitation facilities managed by the People's Armed Forces; stipulating the time limit for publicly posting compensation, support and resettlement plans to be 10 days. The time limit for organizing dialogues in cases where there are still disagreements about the compensation, support and resettlement plans is 30 days...

The third group is the contents to continue to remove difficulties and obstacles in the process of implementing the Land Law such as land recovery, compensation, support, resettlement; land allocation, land lease, change of land use purpose; land finance, land price; conditions for selling assets on leased land with annual payment; amending and supplementing regulations on land plot consolidation, land plot separation, registration, granting of land use right certificates, ownership of assets attached to land for some specific cases.

The National Assembly heard the Economic and Financial Committee's examination report on the draft Resolution of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law.

The submission of the above draft Resolution to the National Assembly stems from the requirements in the new situation in order to continue to institutionalize the Party's viewpoints and orientations; at the same time, remove difficulties and obstacles in the process of organizing the implementation of the Land Law after more than 1 year of implementing the 2024 Land Law and documents guiding the implementation of the Law.

During the working day, the National Assembly discussed in the hall the draft Law on amending and supplementing a number of articles of the Law on Public Debt Management; the draft Law on amending and supplementing a number of articles of the Law on Insurance Business; and the draft Law on amending and supplementing a number of articles of the Law on Anti-Corruption.
