Regulations on the organization of specialized agencies under the Provincial and Commune People's Committees
The Government issued Decree No. 150/2025/ND-CP dated June 12, 2025, regulating the organization of specialized agencies under the People's Committees of provinces and centrally-administered cities, and the People's Committees of communes, wards, and special zones under provinces and centrally-administered cities.

REGULATIONS ON SPECIALIZED AGENCIES UNDER THE PROVINCIAL PEOPLE'S COMMITTEE
Structure and functions of the Department
The decree stipulates that the department is a specialized agency under the Provincial People's Committee. The department has legal personality, its own seal and bank account as prescribed by law; it performs the function of advising and assisting the Provincial People's Committee in the state management of the industry and field at the local level as prescribed by law.
The Department is responsible for submitting draft documents within the authority of the Chairman of the Provincial People's Committee to issue, as assigned; organizing the implementation of legal documents, plans, and programs after their approval; providing information, conducting propaganda, guidance, dissemination, education, and monitoring the implementation of laws in the fields under its assigned state management; organizing and being responsible for the assessment, registration, licensing, diplomas, and certificates within the scope of responsibility of provincial-level specialized agencies as prescribed by law; managing, in accordance with the law, enterprises, collective economic organizations, private economic organizations, associations, and non-governmental organizations within its sector and field; managing the activities of public and private service units within its sector and field...
Provinces and cities may organize no more than 14 departments.
The organizational structure of the department includes: Specialized and professional divisions; Office (if any); Sub-departments and equivalent organizations (if any); Public service units (if any).
Article 8 of Decree 150/2025/ND-CP stipulates that the following departments are uniformly organized at the local level: 1- Department of Internal Affairs; 2- Department of Justice; 3- Department of Finance; 4- Department of Industry and Trade; 5- Department of Agriculture and Environment; 6- Department of Construction; 7- Department of Science and Technology; 8- Department of Culture, Sports and Tourism; 9- Department of Education and Training; 10- Department of Health; 11- Provincial Inspectorate; 12- Office of the People's Committee.
Article 9 of Decree 150/2025/ND-CP stipulates that specialized departments shall be organized in some localities, including: 1- Department of Foreign Affairs; 2- Department of Ethnic Minorities and Religion; 3- Department of Tourism; 4- Department of Planning and Architecture, established in Hanoi and Ho Chi Minh City.
The Decree also clarifies that, based on the provisions of Articles 8 and 9 of this Decree, provinces and cities may organize no more than 14 departments, while Hanoi and Ho Chi Minh City may have no more than 15 departments.
The one-level Public Administrative Service Center, directly under the Provincial People's Committee, operates in accordance with the regulations of the Government.
SPECIALIZED AGENCIES UNDER THE COMMUNE-LEVEL PEOPLE'S COMMITTEE
Location and function of the room
The decree stipulates that the department is a specialized agency under the People's Committee at the commune level; it performs the function of advising and assisting the People's Committee at the commune level in managing state affairs in the local sector and field in accordance with the law.
Departments under the People's Committee at the commune level are subject to the direction and management of organizational structure, job positions, civil servant staffing, civil servant rank structure, number of employees, and the structure of public service employees by professional title in public service units and the work of the People's Committee at the commune level. They are also subject to the direction, inspection, and guidance on professional expertise from specialized agencies under the People's Committee at the provincial level.
The department is responsible for organizing the implementation of legal documents, plans, and programs after their approval; providing information, disseminating, and educating the public on laws related to the areas under its assigned management; monitoring the implementation of laws; assisting the People's Committee at the commune level in the appraisal, registration, and issuance of various types of licenses, certificates, and equivalent documents within the scope of responsibility and authority of specialized agencies as prescribed by law and as assigned by the People's Committee at the commune level; assisting the People's Committee at the commune level in the state management of collective and private economic organizations, associations, and non-governmental organizations operating in the area under the management of specialized agencies as prescribed by law; organizing the application of scientific and technological advancements; building information systems, promoting innovation and digital transformation, and archiving to serve state management and professional work of specialized agencies at the commune level...
The commune has 3 specialized departments.
Article 15 of Decree 150/2025/ND-CP stipulates that specialized departments organized at the commune level include:
1. The Office of the People's Council and the People's Committee advises and assists the People's Committee at the commune level in performing its state management functions in the following areas: Office administration; Justice; and Foreign affairs.
2. The Economic Department (for communes and special zones) or the Economic, Infrastructure and Urban Department (for wards and Phu Quoc special zone) advises and assists the People's Committee at the commune level in performing state management functions in the following areas: Finance - Planning; Construction and Industry and Trade; Agriculture and Environment.
3. The Department of Culture and Social Affairs advises and assists the People's Committee at the commune level in performing its functions of state management in the following areas: Internal Affairs; Education and Training; Culture, Science and Information; and Health.
The Decree states that, based on the provisions of Article 15 of this Decree and the requirements of state management in the industry and field at the local level, the commune-level local government shall decide on the establishment of specialized departments.
The Public Administrative Service Center under the People's Committee at the commune level operates in accordance with the regulations of the Government.
Responsibilities of the People's Committee at the provincial and commune levels.
In addition, the Decree also clearly defines the responsibilities of the People's Committees at the provincial and commune levels.
The responsibilities of the provincial People's Committee include:The regulations specify the functions, tasks, and powers of each department in accordance with the guidelines of the ministry managing the relevant sector; determine the organizational structure and the number of Deputy Directors of each department in accordance with the requirements of state management of the sector at the local level and the criteria stipulated in this Decree; and regulate the functions, tasks, powers, and organizational structure of sub-departments and public service units under the departments in accordance with the provisions of this Decree, except where specialized laws provide otherwise.
The provincial People's Committee decides on the establishment, reorganization, and dissolution of public non-business units under its departments in accordance with the law, ensuring compliance with the approved network plan of public non-business units by sector and field, the guidance of the ministry managing the sector and field, and the Ministry of Interior; it also delegates or authorizes the performance of one or more tasks and powers within the authority of the provincial People's Committee in accordance with the law...
