High quality Viet Nhat Vocational Training Center project leased by the Provincial People's Committee 2,887m2land in Quan Bau ward (Vinh city) with a land lease term of 40 years. According to the socialization policy, this project is exempted from land rent from January 2011 to the end of December 2047. However, there are many problems in this project, as Mr. Pham Duc Tho - Vice Chairman of Quan Bau ward People's Committee summarized: "The project enjoys incentives of not having to pay land rent, but the investor leases it for production and business purposes that are not for the right purpose, and after inspection, it is found to be a wood workshop. In addition, the project has been around for a very long time but has not been implemented, causing waste of resources, unsanitary conditions, environmental pollution, affecting the urban beauty of the whole area...".
The assessment of Nghe An Tax Department in a document sent to competent authorities in June 2023 stated: “The project operates in the field of education - vocational training, which is encouraged by the province to invest in accordance with the policy of socialization. However, during the construction process, there were many comments from the people about the investor using the land for the wrong purpose to build a warehouse, a wood storage yard, the local government has notified and reminded many times but the investor has not yet corrected; through actual inspection, the investor used the land for the wrong purpose (the current practice workshop is being used as a sawmill, sawing wood. The post-training product production area is being used by cadres)…”.
In the past time, it is known that the Viet Nhat High-Quality Vocational Training Center Project in Quan Bau Ward (Vinh City) has received "attention" from relevant levels, sectors and functional units. On January 30, 2024, based on the inspection results and opinions of departments and sectors, the Department of Natural Resources and Environment issued Document No. 15/STNMT-QLDD reporting and advising the Provincial People's Committee to handle the project. On February 19, 2024, the Provincial People's Committee issued Document No. 66/UBND-CN assigning the Department of Natural Resources and Environment to preside over and continue working with the following departments, sectors and localities: Construction, Planning and Investment, Finance, Labor - Invalids and Social Affairs, Provincial Tax Department, Vinh City People's Committee and relevant agencies to unify related contents, report and propose appropriate handling options in accordance with regulations. Carrying out the assigned tasks, on March 22, 2024, the Department of Natural Resources and Environment issued Official Dispatch No. 35/STNMT-QLDD reporting the inspection results of the Viet Nhat High-Quality Vocational Training Center Project in Quan Bau Ward, Vinh City to the Provincial People's Committee.
And then on April 23, 2024, in Document No. 3186/UBND-CN, the Provincial People's Committee gave its opinion on the policy of handling the Viet Nhat High-Quality Vocational Training Center Project in Quan Bau Ward, Vinh City with the following specific content:
“At the request of the Department of Natural Resources and Environment in Official Dispatch No. 35/STNMT-QLDD dated March 22, 2024, on the inspection results report for the Viet Nhat High-Quality Vocational Training Center Project in Quan Bau Ward, Vinh City.
The Provincial People's Committee has the following comments:
Agree to the land recovery policy according to the provisions of Point I, Clause 1, Article 64, Land Law 2013 for the Viet Nhat High-Quality Vocational Training Center Project in Quan Bau Ward, Vinh City as proposed by the Department of Natural Resources and Environment in the above Official Dispatch.
The Department of Natural Resources and Environment shall preside over and coordinate with relevant units to advise and draft a decision for the Provincial People's Committee to reclaim land in accordance with current legal regulations. To be completed before May 5, 2024.
Assign the Provincial Tax Department to inspect and handle the exemption and reduction amount and other financial obligations related to the project in accordance with regulations.
Assign the Departments of Natural Resources and Environment, Planning and Investment, Construction, Finance and Vinh City People's Committee, according to their functions and tasks, to advise the Provincial People's Committee on procedures for handling land, assets and other issues related to the project according to current regulations.
In August 2023, when Nghe An Newspaper reporters went to Quan Bau ward to investigate and write an article “The project of “enclosing land” under the guise of a high-quality vocational training center”, Vice Chairman of the Ward People's Committee Pham Duc Tho expressed: “Quan Bau ward has formed many more urban areas and residential areas in recent years, so education is under a lot of pressure regarding schools and classrooms. Therefore, we hope that the Provincial People's Committee will consider revoking the project, so that the land can be used for the right purpose as an educational facility. Specifically, using the land to build schools to serve future generations in the area…”.
Upon receiving the document dated April 23, 2024 of the Provincial People's Committee, we (PV) informed the policy of handling the High-Quality Viet Nhat Vocational Training Center Project of the Provincial People's Committee to Quan Bau Ward. In an exchange on May 6, 2024, Chairman of the Ward People's Committee Tran Hoang Tuan said that in March 2024, the ward was consulted by the Department of Natural Resources and Environment for comments on the draft supplementary report to advise the Provincial People's Committee on handling the High-Quality Viet Nhat Vocational Training Center Project.
Responding to the Department of Natural Resources and Environment, the People's Committee of Quan Bau Ward commented: "Since the Nghe An Provincial People's Committee leased the land in Decision No. 599/QD-UBND dated December 12, 2007 until now, the Viet Nhat High-Quality Vocational Training Center has not fully constructed the items according to the approved planning. The school campus is surrounded by a fence and locked, not in operation, some of the internal works are old, degraded, damaged, causing waste of land resources, unsanitary conditions, environmental pollution, affecting the urban beauty of the whole area. Through information gathering, the Viet Nhat High-Quality Vocational Training Center has used the land for the wrong purpose when it let a business use it (Dong Kham Phou Company Limited). On the other hand, the Viet Nhat High-Quality Vocational Training Center has been granted an extension by the Provincial People's Committee once (in 2017), but during the extension period, the project has not been implemented. Therefore, the People's Committee of Quan Bau Ward does not agree with Proposal for extension of Viet Nhat High Quality Vocational Training Center".
Therefore, according to Chairman of the Ward People's Committee Tran Hoang Tuan, the staff and people of Quan Bau Ward were very happy with the news that the Provincial People's Committee agreed to the land recovery policy for the Viet Nhat High-Quality Vocational Training Center Project. Mr. Tran Hoang Tuan also reiterated that the school grounds of the primary school in the area did not ensure the area, the location was not convenient for students to travel to and from school in the area, so he hoped that after the land recovery, the Provincial People's Committee and related departments and branches would consider using the area as the second facility of the primary school. "We have raised this content at a number of meetings of the Ward People's Council, and have also proposed recommendations to the provincial inspection team during the inspection of the Viet Nhat High-Quality Vocational Training Center Project. Now that the Provincial People's Committee has agreed to implement the land recovery policy, the Quan Bau Ward People's Committee hopes that this proposal will be considered and resolved...", said Chairman of the Quan Bau Ward People's Committee Tran Hoang Tuan.
