On November 3, 2023, the People's Committee of Cua Lo town issued Document No. 1878/UBND-TN clarifying a number of contents related to the articles "Signs of violations within the planning scope of Road 21, Cua Lo town"; "The intricacies in land recovery within the planning scope of Road 21, Cua Lo town" published by Nghe An Newspaper on October 26 and November 2, 2023. Document No. 1878/UBND-TN was sent to the Standing Committee of the Provincial Party Committee; the Provincial Party Committee's Inspection Committee; the Provincial Party Committee's Internal Affairs Committee, the Provincial Party Committee's Propaganda Department; the Standing Committee of Cua Lo Town Party Committee and Nghe An Newspaper. The content of Document No. 1878/UBND-TN of the People's Committee of Cua Lo town can be summarized as follows:
The planning of cross-road No. 21 in Nghi Hoa ward, Cua Lo town belongs to the project to adjust the 1/2000 scale zoning plan of Nghi Hoa ward, Cua Lo town approved by the Provincial People's Committee in Decision No. 255/QD-UBND dated January 28, 2021. For the 2 housing projects built within the planning boundary of cross-road No. 21, which the article "Signs of violations within the planning scope of road 21, Cua Lo town" reflects, the Town People's Committee has granted construction permits in accordance with the provisions of Decision No. 84/2016/QD-UBND dated December 27, 2016 of the Provincial People's Committee on promulgating regulations on granting construction permits in Nghe An province.
During the construction process of 2 households, the People's Committee of Nghi Hoa Ward and the Urban Order Management Team of the town inspected the compliance with construction order and required people to build houses in accordance with the granted construction permit. On October 17, 2023, the Urban Order Management Team of the town made a record of a household for violating the construction setback and required the family to dismantle the violating construction.
However, with the suggestion of Nghe An Newspaper, in the coming time, the Town People's Committee will assign specialized staff in charge of granting construction permits to learn and draw experience in the process of guiding people in the procedures for granting construction permits for projects within the planning boundary, using appropriate materials, minimizing damage to people when the state reclaims land to do projects according to the planning.
Regarding land acquisition, compensation and resettlement of households and individuals in the planning of the No. 21 cross-road project in 2021, stemming from the fact that the No. 21 cross-road project is in the 2021 land use plan approved by the Provincial People's Committee in Decision No. 60/QD-UBND dated February 3, 2021; approved by the Provincial People's Council on the list of works and projects requiring land acquisition as prescribed in Clause 3, Article 62 of the Land Law in Resolution No. 33/NQ-HDND dated December 13, 2020. Crossroad No. 21 project is one of the key works and projects of the town included in the master plan for compensation, support for site clearance, land acquisition, resettlement arrangement, and population rearrangement to implement key works and projects in Cua Lo town in the period of 2020-2025 issued by the Town People's Committee in Plan No. 109/KH-UBND dated August 4, 2020.
However, through the initial review of land acquisition, compensation and resettlement of plot 408, map sheet 13 in Nghi Hoa ward, the recovered land area is 151.6 m2.2was assigned 2 resettlement plots with a total area of 410 m22(area of each lot is 205 m)2), The People's Committee of Cua Lo town realized that there was a situation of favoritism and favoritism, which led to the situation as reported by Nghe An Newspaper. That is, the site clearance has not been carried out synchronously with households within the project scope, but only considered and resolved cases with requests for land recovery and resettlement arrangements. The construction, appraisal and approval of compensation land prices and resettlement land prices are still subjective and inaccurate. The allocation of resettlement land for households with shared land use rights, each person gets 1 plot of land for 2 subjects with shared land use rights for plot No. 408, map No. 13 in Nghi Hoa ward is still subjective, not strict and not suitable.
Realizing that the implementation of land acquisition, site clearance compensation and resettlement is still subjective and not strict, the People's Committee of Cua Lo town has Document No. 14/Ttr-UBND asking for opinions from the Standing Committee and the Standing Committee of the Town Party Committee to consider and decide:
“1. Review and synthesize records of land recovery and individual resettlement arrangements within the planning boundaries of construction works and projects implemented from January 2020 to June 2023; implementation period from November 7, 2023 to November 17, 2023.
2. Establish a self-inspection team to review and reconsider the above records. After receiving the self-inspection results, the Town People's Committee will synthesize a report of the results and remedial measures for each specific case.
After Nghe An Newspaper published the article "Signs of violations within the planning scope of Road 21, Cua Lo Town", on October 30, 2023, Cua Lo Town Party Committee issued Official Dispatch No. 911-CV/Thu requesting Cua Lo Town People's Committee to review, synthesize, and explain the information reported by the newspaper, and send a written response to the Editorial Board of Nghe An Newspaper; direct the review of the responsibilities of relevant organizations and individuals for violations (if any), and take remedial measures.
On November 6, 2023, the Standing Committee of the Cua Lo Town Party Committee held an extraordinary meeting to listen to the Town People's Committee's report and explanation, and propose solutions to overcome the contents mentioned by Nghe An Newspaper. After listening to the presentation of the Town People's Committee representative and the discussion opinions of the participants, the Standing Committee of the Cua Lo Town Party Committee requested the Town People's Committee to implement a number of contents:
– Agree in principle to have the Town People's Committee review the implementation of land acquisition, resettlement, and resettlement arrangements in the town.
- Establish a working group to carry out the tasks, and at the same time clearly define the responsibilities of relevant groups and individuals in accordance with the provisions of law.
- After reviewing, propose solutions and report to the Standing Committee of the City Party Committee.
The review is due to be completed by November 20, 2023. The review period is from January 2020 to June 2023.
According to Mr. Le Thanh Long - Standing Deputy Secretary of Cua Lo Town Party Committee, on November 8, 2023, the Town Party Committee issued a notice of the conclusion of the Standing Committee of the Town Party Committee at the extraordinary meeting held on November 6, 2023; at the same time, there was a written report on the handling of the case raised by Nghe An Newspaper to the Standing Committee of the Provincial Party Committee, the Provincial Party Committee's Inspection Committee and the Provincial Party Committee's Internal Affairs Committee.
Standing Deputy Secretary of Cua Lo Town Party Committee, Mr. Le Thanh Long, said: “The viewpoint of the Standing Committee of the Town Party Committee is to thank Nghe An Newspaper for pointing out possible omissions or violations in the process of planning, site clearance, land acquisition, and resettlement. This is timely information, so that the Standing Committee of the Town Party Committee is aware that there may be omissions in the process of leadership and direction in inspecting and supervising relevant agencies in performing their duties. Regarding the explanatory report of the People's Committee of Cua Lo Town on the contents mentioned by the Newspaper, the Standing Committee of the Town Party Committee acknowledged the initial results. Here, it is noted that after receiving the information mentioned by Nghe An Newspaper, the People's Committee of Cua Lo Town was aware that there may have been omissions or violations in the process of implementing the tasks; thereby promptly reporting and proposing to the Standing Committee of the Town Party Committee for a policy to review the implementation of land acquisition, site clearance, and resettlement. However, the Standing Committee of the Town Party Committee will carry out many Supervisory measures to ensure the review results of the People's Committee of Cua Lo town are accurate, honest, and objective...".
