Authority to resolve complaints at commune, district and provincial levels

(Baonghean) - According to the Law on Complaints passed by the National Assembly on November 11, 2011, the authority to resolve complaints at the commune, district and provincial levels is stipulated as follows:

Article 17.Authority of the Chairman of the People's Committee of a commune, ward or town and the head of an agency under the People's Committee of a district, town or provincial city: The Chairman of the People's Committee of a commune, ward or town (hereinafter referred to as the commune level); The head of an agency under the People's Committee of a district, town or provincial city (hereinafter referred to as the district level) has the authority to resolve first-level complaints regarding their administrative decisions and administrative acts or those of responsible persons under their direct management.

Article 18.Authority of the Chairman of the District People's Committee:

1. Resolve first-time complaints about administrative decisions and administrative acts of oneself. 2. Resolve second-time complaints about administrative decisions and administrative acts of the Chairman of the People's Committee at the commune level, the head of the agency under the People's Committee at the district level that have been resolved for the first time but still have complaints or the first-time complaints have expired but have not been resolved.

Article 19.Authority of heads of agencies under departments and equivalent levels: Heads of agencies under departments and equivalent levels have the authority to resolve initial complaints regarding administrative decisions and administrative acts of themselves and of cadres and civil servants under their direct management.

Article 20.Authority of department directors and equivalent levels: 1. Resolve first-time complaints about administrative decisions and administrative acts of themselves and of cadres and civil servants under their direct management; 2. Resolve second-time complaints about administrative decisions and administrative acts of heads of agencies under the department and equivalent levels that have been resolved the first time but are still subject to complaints or first-time complaints have expired but have not been resolved.

Article 21.Authority of the Chairman of the Provincial People's Committee:
1. Resolve first-time complaints about administrative decisions and administrative acts of its own. 2. Resolve second-time complaints about administrative decisions and administrative acts of district-level People's Committee Chairmen, Department Directors and equivalent levels that have been resolved for the first time but still have complaints or the first-time complaints have expired but have not been resolved. 3. Resolve disputes over the authority to resolve complaints between agencies and units under its management.
