Jurisdiction for resolving complaints at the commune, district, and provincial levels.

(Baonghean) - According to the Law on Complaints passed by the National Assembly on November 11, 2011, the authority to resolve complaints at the commune, district, and provincial levels is regulated as follows:

Article 17.The authority of the Chairpersons of the People's Committees of communes, wards, and towns, and the heads of agencies under the People's Committees of districts, towns, and cities under provinces: The Chairpersons of the People's Committees of communes, wards, and towns (hereinafter referred to as the commune level); and the heads of agencies under the People's Committees of districts, towns, and cities under provinces (hereinafter referred to as the district level) have the authority to resolve initial complaints regarding administrative decisions and administrative actions of themselves and of those responsible under their direct management.

Article 18.Authority of the Chairman of the People's Committee at the district level:

1. Resolving initial complaints against their own administrative decisions and actions. 2. Resolving second-level complaints against administrative decisions and actions of the chairman of the commune-level People's Committee or the head of an agency under the district-level People's Committee that were initially resolved but remain subject to further complaints, or where the initial complaint deadline has expired but the complaint has not yet been resolved.

Article 19.Authority of heads of agencies under the department and equivalent levels: Heads of agencies under the department and equivalent levels have the authority to resolve initial complaints regarding administrative decisions and actions of themselves and of officials and civil servants under their direct management.

Article 20.Authority of the director of a department and equivalent level: 1. To resolve initial complaints against administrative decisions and actions of themselves and of officials and civil servants under their direct management; 2. To resolve second-level complaints against administrative decisions and actions of heads of agencies under the department and equivalent level that have been initially resolved but are still subject to appeal, or where the initial complaint has expired but has not yet been resolved.

Article 21.Authority of the Chairman of the Provincial People's Committee:
1. Resolving initial complaints against its own administrative decisions and actions. 2. Resolving second-level complaints against administrative decisions and actions of district-level People's Committee chairmen, department directors, and equivalent levels that were initially resolved but remain subject to further complaints, or where the initial complaint deadline has expired but the complaint has not yet been resolved. 3. Resolving disputes regarding the jurisdiction for handling complaints between agencies and units under its management.
