(Baonghean)Recently, Nghe An Newspaper received complaints from several households in Tho Son commune (Anh Son district) regarding Mr. Dinh Van Suu, former Chairman of the Tho Son Commune People's Committee, allegedly abusing his position and authority to seize thousands of square meters of forest land belonging to local residents. Based on the complaints and subsequent investigation, the residents' claims are true. The Anh Son District People's Committee has now addressed the issue and is actively working to complete the procedures for issuing land use right certificates to the affected households.

Regarding Tho Son commune, we learned that in 1967, following the State's policy, hundreds of families from Nam Dan district volunteered to move to Tho Son commune to build a new economic zone. In 1990, these households submitted applications to receive forest land. Their applications were signed by Mr. Dinh Van Suu, then Chairman of the People's Committee of the commune. In 1991, these households were granted forest land certificates. However, in 2002, implementing Decree 163/ND-CP to revoke the forest land certificates (green certificates) of households previously allocated land and forest to issue land use right certificates (red certificates), the People's Committee of Tho Son commune revoked all green certificates issued to the households. In 2004, Mr. Suu resigned from his position as Chairman of the People's Committee of the commune. After the issuance of land use right certificates, some households discovered that their land had been seized by Mr. Dinh Van Suu, the former Chairman of the People's Committee of Tho Son commune.

According to Ms. Nguyen Thi Cot, residing in Hamlet 5, Tho Son Commune: From 1990 to the present, her family has been cultivating crops on an area of ​​20,000 square meters.2The land was handed over on September 28, 1990, with the signature of Mr. Dinh Van Suu, and was issued a green cover. However, for some unknown reason, the land use right certificate for the 20,000m² plot is missing.2The family's land was divided into two, with plot 149 belonging to the family now only measuring 2,743 square meters.2Plot 150, registered under the name of Mr. Dinh Van Suu, has an area of ​​11,265m².2Mr. Nguyen Dinh Kien, also residing in Hamlet 5, stated: In 1997, Mr. Bui Giang Chau's household transferred 20,000 square meters of land to him.2Residential land and hilly area. The transfer deed was certified by the village head and the Thọ Sơn Commune People's Committee, signed by Mr. Đinh Văn Sửu, Chairman of the Commune People's Committee. Since receiving the transfer, he has erected concrete pillars and planted a row of acacia trees as a boundary and cultivated crops on the land. Yet, on the Land Use Right Certificate, in the middle of his plot of land, there suddenly appears plot number 178, map sheet number 3, with an area of ​​9,904m².2Registered under the name of Mr. Dinh Van Suu.

It has been learned that in 2005, following Official Letter No. 2108/TNMT.ĐK dated August 25, 2005, from the Department of Natural Resources and Environment regarding the preparation of cadastral records for the issuance of land use right certificates for forestry land, the Department of Natural Resources and Environment of Anh Son district guided and directed communes and towns in the district to implement the process. By April 2008, the Thọ Sơn Commune People's Committee had prepared a dossier requesting the Anh Son District People's Committee to issue a land use right certificate for plot No. 150, map sheet No. 3 to Mr. Dinh Van Suu, Hamlet 5, Thọ Sơn Commune, and the certificate was issued by the Anh Son District People's Committee in Decision No. 3654/QĐ-UBND.ĐC dated November 10, 2008. After the land use right certificate for plot No. 150, map sheet No. 3 was issued to Mr. Dinh Van Suu, Ms. Nguyen Thi Cot filed a complaint with the Anh Son District People's Committee.

After receiving the application, the Anh Son District People's Committee established a verification team and requested Mr. Dinh Van Suu to provide original documents to prove that his family had been granted the necessary permits for plot number 150, map sheet number 3, which is currently being disputed by Mrs. Cot's family. However, Mr. Dinh Van Suu failed to provide any documents. Regarding Mrs. Nguyen Thi Cot's family, during the verification process, they presented to the team an application for forest land dated February 25, 1990, with Mr. Bui Quoc Viet (her son) as the land user, clearly stating the total area requested as 20,000 square meters.2(of which natural forest is 16,500m)2The vacant land for reforestation is 2,000m².2The residential land is 500m².2, other land 1,000m2). The application bears the signature and confirmation of Mr. Dinh Van Suu, Chairman of the People's Committee of Tho Son Commune.

The inspection team confirmed that the application for forest land allocation was an original document, bearing the fresh signature of Mr. Dinh Van Suu, the former Chairman of the commune during the 1990 period. Based on this, the inspection team concluded that the land currently in dispute between Ms. Cot and Mr. Suu originated from land that Mr. Bui Quoc Viet had been cultivating and protecting since 1990. “Mr. Bui Quoc Viet’s application for forest land allocation, dated February 22, 1990, and confirmed by Mr. Dinh Van Suu, Chairman of the Thọ Sơn Commune People’s Committee, is legally valid.” Based on this, the team concluded that the 2002 forest land allocation file, prepared by the Thọ Sơn Commune People’s Committee and approved by the Anh Sơn District People’s Committee, for plot number 150, map sheet number 3, which allocated land to Mr. Dinh Van Suu as the land user, should be annulled. At the same time, it was acknowledged that the land plot currently in dispute between Mr. Dinh Van Suu and Ms. Nguyen Thi Cot has original land use documents registered in the name of Mr. Bui Quoc Viet (Ms. Cot's son).

Similarly, in the case of Mr. Nguyen Dinh Kien's family, the inspection team concluded: "Through verification, Mr. Suu stated that in 1991 he received land and forest and had a Decision to grant land (white forest register) for the disputed land. However, in reality, the inspection team verified the relevant individuals and checked the records at the commune People's Committee and the district land use rights registration office, but could not find any white or green forest registers under the name of household head Dinh Van Suu. Therefore, Mr. Suu's claim that the disputed land belongs to his family and was granted by the State in 1991 is unfounded. At the same time, it is recognized that the disputed forest land area between Mr. Nguyen Dinh Kien and Mr. Dinh Van Suu in Hamlet 5, Tho Son commune, belongs to Mr. Nguyen Dinh Kien."

Speaking with us, Mr. Nguyen Huu Sang, Vice Chairman of the Anh Son District People's Committee, said that after verification, the district has now issued a decision to cancel the land allocation records for plots 150 and 178, map sheet number 3, registered under the name of Mr. Dinh Van Suu. Regarding the land Mr. Suu illegally seized from Ms. Cot, the district has now issued a Certificate of Land Use Rights to Ms. Cot's family; regarding the land Mr. Suu illegally seized from Mr. Kien's household, the district has completed the necessary procedures and is currently conducting an assessment to proceed with issuing a Certificate of Land Use Rights to Mr. Kien in accordance with regulations.

Thus, the public's complaint that the former Chairman of the People's Committee of Tho Son commune (Anh Son district) illegally occupied land is true. The Anh Son district authorities have actively intervened to handle this matter. However, when asked about how to handle Mr. Dinh Van Suu's land encroachment, some officials in Anh Son district stated that they were unsure how to proceed because Mr. Suu had already retired.
