Confused in handling violations
(Baonghean) -Recently, Nghe An Newspaper received a petition from a number of households in Tho Son Commune (Anh Son) reflecting on the fact that Mr. Dinh Van Suu, former Chairman of Tho Son Commune People's Committee, took advantage of his position and power to appropriate thousands of square meters of forestry land from households. From the content of the reflection, through actual investigation, the reflection of the people is true. Currently, Anh Son District People's Committee has handled the case and is actively completing the procedures to issue Land Use Rights Certificates to the households whose land was appropriated.

Regarding Tho Son commune, we learned that in 1967, implementing the State's policy, hundreds of families in Nam Dan district volunteered to go to Tho Son commune to build a new economic zone. In 1990, households submitted applications to receive forest land. Their applications were signed by Mr. Dinh Van Suu - Chairman of the Commune People's Committee at that time. In 1991, the above households were granted forest registers. However, in 2002, implementing Decree 163/ND-CP to revoke the forest registers (green covers) of households previously allocated land and forests to issue Land Use Right Certificates (red covers), Tho Son Commune People's Committee revoked all green covers issued to households. In 2004, Mr. Suu resigned from the position of Chairman of the Commune People's Committee. After granting the Land Use Right Certificates, some households discovered that their land area had been appropriated by Mr. Dinh Van Suu, former Chairman of Tho Son Commune People's Committee.
According to Ms. Nguyen Thi Cot, residing in Hamlet 5, Tho Son Commune: From 1990 until now, her family has been growing crops on an area of 20,000m2.2was delivered on September 28, 1990, signed by Mr. Dinh Van Suu and issued a green cover. But for some reason, on the Land Use Rights Certificate, the 20,000m2 plot of land2The family's land was divided into two, of which plot 149 of her family was only 2,743m2.2, plot 150 named after Mr. Dinh Van Suu has an area of 11,265m2? Mr. Nguyen Dinh Kien, also residing in hamlet 5, said: In 1997, Mr. Bui Giang Chau's household transferred to him an area of 20,000m2 of land.2Residential land and hilly areas. The transfer paper was confirmed by the village chief and the People's Committee of Tho Son commune, signed by Mr. Dinh Van Suu, Chairman of the People's Committee of the commune. Since receiving the transfer, he has buried concrete pillars and planted a row of acacia trees as a boundary and planted crops on it. However, on the Land Use Rights Certificate, in the middle of his land plot, there is suddenly an additional plot of land number 178, map sheet number 3, with an area of 9,904m2.2registered under Mr. Dinh Van Suu.
It is known that in 2005, implementing Official Letter No. 2108/TNMT.DK dated August 25, 2005 of the Department of Natural Resources and Environment on establishing cadastral records to issue Certificates of Forestry Land Use Rights. The Department of Natural Resources and Environment of Anh Son district has guided and directed communes and towns in the district to implement. By April 2008, the People's Committee of Tho Son commune prepared a dossier requesting the District People's Committee to issue a Certificate of Land Use Rights to Mr. Dinh Van Suu, Hamlet 5, Tho Son commune and was issued by the District People's Committee in Decision No. 3654/QD-UBND.DC dated November 10, 2008 of the People's Committee of Anh Son district. After the land plot No. 150, map No. 3 was issued a Certificate of Land Use Rights to Mr. Dinh Van Suu's household, Ms. Nguyen Thi Cot filed a complaint to the People's Committee of Anh Son district.
After receiving the application, the People's Committee of Anh Son district established a verification team, asking Mr. Dinh Van Suu to provide relevant original documents to prove that his family had been granted documents for land plot No. 150, map sheet No. 3 that Mrs. Cot's family is currently disputing, but Mr. Dinh Van Suu could not provide any documents or papers. Regarding Mrs. Nguyen Thi Cot's family, through verification, her family presented to the team an application for receiving forest land written on February 25, 1990, the user was Mr. Bui Quoc Viet (her son), which clearly stated the total area requested to receive was 20,000m2.2(of which natural forest is 16,500m)2, vacant land for afforestation is 2,000m2, residential land is 500m2, other land 1,000m2). The application is signed and confirmed by Mr. Dinh Van Suu, Chairman of Tho Son Commune People's Committee.
The inspection team confirmed that the application for receiving forest land was an original document, with the fresh signature of Mr. Dinh Van Suu, former Chairman of the commune in 1990. On that basis, the inspection team concluded that the land plot currently in dispute between Ms. Cot and Mr. Suu originated from the land that Mr. Bui Quoc Viet had received for protection since 1990. "The application for receiving forest land by Mr. Bui Quoc Viet made on February 22, 1990, confirmed by Mr. Dinh Van Suu, Chairman of the People's Committee of Tho Son commune, is legally valid". Based on the above, the team concluded to cancel the forestry land allocation file in 2002 made by the People's Committee of Tho Son commune and approved by the People's Committee of Anh Son district for land plot No. 150, map sheet No. 3, which had been established to allocate land to the land user, Mr. Dinh Van Suu. At the same time, it is acknowledged that the land plot currently in dispute between Mr. Dinh Van Suu and Ms. Nguyen Thi Cot has original documents under the name of the land user, Mr. Bui Quoc Viet (Ms. Cot's son).
Similarly, in the case of Mr. Nguyen Dinh Kien's family, the inspection team concluded that "After verification, Mr. Suu stated that in 1991 he received land, received forest and had a land allocation decision (white forest book) for the disputed land, but in fact the inspection team verified the relevant people and checked the documents at the People's Committee of the commune and the district land use rights registration office, but did not find a white forest book or green forest book in the name of the household owner Dinh Van Suu. Therefore, Mr. Suu's claim that the disputed land belonged to his family and was granted by the State in 1991 is unfounded. At the same time, the area of forestry land in dispute between Mr. Nguyen Dinh Kien and Mr. Dinh Van Suu in Hamlet 5, Tho Son Commune is recognized as belonging to Mr. Nguyen Dinh Kien.
Talking to us, Mr. Nguyen Huu Sang - Vice Chairman of Anh Son District People's Committee said that after checking and verifying, the district has now decided to cancel the forestry land allocation records for plots 150 and 178, map sheet number 3 under the name of Mr. Dinh Van Suu. For the land that Mr. Suu appropriated from Ms. Cot, the district has now issued a Land Use Right Certificate to Ms. Cot's family to transfer to her family; for the land that Mr. Suu appropriated from Mr. Kien's family, the district has completed the records and procedures and is conducting an appraisal to issue a Land Use Right Certificate to Mr. Kien in accordance with regulations.
Thus, the people's reflection that the former Chairman of Tho Son Commune People's Committee (Anh Son) occupied land is true. This case has been actively handled by Anh Son district. However, when mentioning the handling of Mr. Dinh Van Suu's land occupation, some officials of Anh Son district said that they did not know how to handle it because Mr. Suu had retired.
