The Standing Committee of the National Assembly discussed the draft Law on Civil Status.

On the afternoon of August 13, under the direction of Vice Chairman of the National Assembly Uong Chu Luu, the National Assembly Standing Committee discussed and gave opinions on the draft Law on Civil Status.

According to the Government's Report, in recent times, the work of civil status registration and management in our country has had many relatively stable developments and achieved specific results, such as the system of management agencies, civil status registration and the staff working in civil status at all levels have been consolidated and improved; civil status data has been formed with long-term storage and use; administrative procedures in civil status registration and management have been reformed...

However, in the context of the country entering a new stage of development, the process of industrialization, modernization and international integration is taking place more and more deeply, the work of registration and management of civil status has revealed many limitations and inadequacies. Therefore, the promulgation of the Law on Civil Status is very necessary to create a long-term, stable and unified legal basis for the work of registration and management of civil status; at the same time, overcome the shortcomings and inadequacies and create a strong change in this work towards professionalism, modernity, suitable for the requirements of national development in the new period.

According to the Government's Submission, the scope of the draft Law on Civil Status clearly stipulates the contents and principles of civil status registration; rights and obligations to register civil status; authority and procedures for registration and issuance of civil status confirmation; civil status database; civil status officers; responsibilities of State agencies in civil status management. The draft Law on Civil Status consists of 6 chapters and 68 articles stipulating: civil status registration; civil status database; civil status officers; responsibilities of State management of civil status.

Giving opinions at the meeting, the majority of members of the National Assembly Standing Committee did not agree with some contents, articles and clauses of the draft Law on Civil Status. According to members of the National Assembly Standing Committee, the contents of the draft Law on Civil Status have not overcome the shortcomings and inadequacies in the work of civil status registration and management.

Members of the National Assembly Standing Committee also said that civil status cannot replace household registration; the civil status registration, personal identification number, method of requesting civil status registration... of the Civil Status Law project are still general and unclear. In particular, the Civil Status Law project has not reduced or replaced the types of documents that people are currently using such as identity cards, household registration books, passports...; on the contrary, it can cause inconvenience in terms of administrative procedures for people.

According to members of the National Assembly Standing Committee, many contents of the draft Law on Civil Status have not clearly shown the position and role of assisting the State in citizen management; at the same time, it also increases the number of staff and salary payments for civil status workers...

Concluding the discussion session, Vice Chairman of the National Assembly Uong Chu Luu emphasized: the provisions of the draft Law on Civil Status do not ensure benefits for the people, nor do they meet the requirements in the work of civil status registration and management.

The Vice Chairman of the National Assembly suggested that the drafting agency should coordinate with the Ministry of Public Security, the Ministry of Home Affairs and the National Assembly's Law Committee to review, research and reconsider all necessary and unnecessary contents of the Civil Status Law project to ensure the interests of the people and the State./.
