Strengthening the management of road transport operations.

(Baonghean.vn) - The People's Committee of Nghe An province has issued Directive No. 09/2015/CT-UBND dated March 7, 2015, on strengthening state management of road transport activities in Nghe An province. The content of the directive is as follows:

Over the past period, various levels of government, agencies, and organizations have made significant efforts in directing and organizing the implementation of traffic safety tasks, achieving many noteworthy results. Traffic accidents have been controlled and gradually reduced for many consecutive years. However, the traffic safety situation remains complex, with some particularly serious traffic accidents occurring in the province involving homemade vehicles, vehicles that have exceeded their service life, and vehicles operating without permits for passenger transport (illegal taxis, etc.).

The main reasons are the lack of decisive and thorough direction and management from all levels and sectors; some units and localities are still lax in state management in this field; the awareness of traffic participants in complying with the law is still weak, with many intentional violations occurring; agricultural vehicles, self-made motorized vehicles, vehicles that have exceeded their service life and are prohibited from use, and unlicensed vehicles are still circulating; and the operation of vehicles without business contract transport permits is still widespread.

To address the above situation, enhance the effectiveness and efficiency of state management over transportation vehicles in the province, and continue to effectively implement Government Decree 86/2014/ND-CP dated September 10, 2014, on business and business conditions for road transport by motor vehicles, and Plan No. 14/KH-UBATGTQG dated January 15, 2015, on the implementation of traffic safety and order in 2015, the Provincial People's Committee requests:

1. People's Committees of districts, cities, and towns

- Conduct a comprehensive review of all passenger buses and trucks currently operating within the managed area to compile a list and clearly classify the service life of each type of vehicle, especially for cars with 9 seats or more, and submit a report to the Provincial People's Committee (via the Department of Transport) before April 20, 2015.

- Instruct the commune-level police where the vehicle owner resides to draw up a report requiring organizations and individuals with vehicles that have exceeded their service life, agricultural vehicles, and self-made 3-wheeled or 4-wheeled vehicles to voluntarily dispose of them; create a list for managing unlicensed passenger vehicles, counterfeit buses, unlicensed taxis, and vehicles with fewer than 9 seats participating in passenger transport. For vehicles that have exceeded their service life, require the vehicle owner to go to the Traffic Police agency to complete the procedures for revoking the vehicle registration certificate and license plate as prescribed.

- The People's Committee at the district level is responsible for supervising the comprehensive review of motorized transport vehicles in the area; coordinating with the Department of Transport to strengthen transport management to prevent the operation of vehicles that have exceeded their service life, agricultural vehicles, and self-made motorized vehicles. The Chairman of the People's Committee and the head of the police at the district and commune levels shall be held responsible if the situation of unlicensed passenger buses, vehicles without contracts, illegal bus stops, and vehicles prohibited from operating is allowed to operate in the area.

- Organizations and individuals are strictly prohibited from manufacturing their own automobiles or similar vehicles for use in traffic in violation of the law, thereby affecting traffic safety and order in the area.

- Strengthen propaganda and mobilization efforts to ensure that vehicle owners and drivers absolutely do not use vehicles that have exceeded their service life, do not transport hazardous, toxic, flammable, or explosive substances on passenger vehicles, do not violate speed limits or alcohol concentration limits, and do not carry overloaded or over-capacity passengers...

2. Provincial Police:

- The Department of Transport, in coordination with the People's Committees of districts, cities, and towns, shall develop a plan to conduct a comprehensive review and statistical survey of the number of road motor vehicles in the province, especially passenger cars with 9 seats or more and unlicensed vehicles. A classification form should be created clearly showing the license plate number and service life of each vehicle for management purposes.

- Direct the Road and Rail Traffic Police Department to use the vehicle registration and management records, including the list of vehicles that have exceeded their service life or are not permitted to circulate according to the law, provided by the vehicle registration authority, to handle violations and revoke vehicle registration certificates and license plates as prescribed.

- Notify and instruct organizations and individuals whose vehicles have reached the end of their service life to go to the Traffic Police agency to complete the procedures for revoking vehicle registration certificates and license plates. Within 15 days from the date of notification, if the vehicle owner does not voluntarily come to complete the procedures, coordinate with the commune-level police to revoke the vehicle registration certificate and license plate; if they intentionally continue to operate the vehicle, the infringing vehicle will be confiscated according to regulations.

- Directing forces to strengthen patrols and controls, and strictly handle the deliberate circulation of road motor vehicles that do not meet technical safety standards. For vehicles that have exceeded their service life, agricultural vehicles, homemade vehicles, and vehicles operating illegally, in addition to administrative penalties, the vehicles must be confiscated in accordance with point d, clause 6, Article 16 of Government Decree 171/ND-2013/ND-CP dated November 13, 2013, regulating administrative penalties in the field of road and rail transport.

3. Department of Transportation

- Strengthen state management of passenger transport business by automobile in the province, review licensed passenger transport enterprises and cooperatives in the area to strictly manage vehicles and drivers; and simultaneously notify relevant authorities to take action to revoke license plates and circulation permits for vehicles that have exceeded their service life or do not meet technical safety standards.

- Preside over and coordinate with the People's Committees of districts, cities, and towns to review and compile a list for strict management of automobiles with 9 seats or more and all types of trucks currently operating in the entire province; guide organizations and individuals wishing to participate in transportation business activities to meet the business requirements and conditions as prescribed by law.

- Direct, urge, and guide units and individuals engaged in road transport business to strictly comply with legal regulations, regularly inspect vehicle technical safety, and immediately dispose of or destroy vehicles that do not meet technical safety standards or have exceeded their service life.

- Implement the management roadmap for road transport business conditions as stipulated in Government Decree 86/2014/ND-CP dated September 10, 2014, on road transport business and business conditions. Disseminate information and guide organizations and individuals participating in tourist transport business activities and contract-based transport to notify the Department of Transport of basic trip information, including: itinerary, number of passengers, pick-up and drop-off points, and contract duration.

- Instruct the road motor vehicle inspection centers to regularly notify the police in districts, cities, and towns, the Traffic Inspectorate, and the Road and Rail Traffic Police Departments about passenger buses and trucks that have reached the end of their service life, so that they can monitor, inspect, and handle violations according to regulations.

- Directing passenger transport businesses and cooperatives in the province to strengthen inspections, reviews, and terminate contracts with drivers who do not meet health requirements, drivers addicted to drugs, and drivers who frequently and intentionally violate traffic safety laws; organizing propaganda and education for drivers to comply with legal regulations and transport business operations, and not to transport dangerous, toxic, flammable, or explosive goods, or prohibited animals... on passenger vehicles.

- Direct the Traffic Inspection force to strengthen inspections, checks, reviews, and strictly handle illegal vehicles, vehicles operating outside designated routes; vehicles that have exceeded their service life; agricultural vehicles and self-made motorized vehicles; passenger vehicles without or not displaying the required route badges (license plates), or with expired badges; transporting dangerous, toxic, flammable, or explosive goods on vehicles; counterfeit buses competing for passengers and operating outside designated routes; coordinate with the Traffic Police force to strictly inspect and manage vehicles with foreign license plates regarding operating conditions and inter-provincial transport permits.

4. Department of Information and Communications; Provincial Radio and Television Station and other mass media:

Strengthen the dissemination of traffic safety laws; produce documentaries to raise awareness and warn about the consequences of traffic accidents caused by the use of vehicles that have exceeded their service life, agricultural vehicles, and self-made motorized vehicles. Publish a list of vehicles that have exceeded their service life, agricultural vehicles, self-made vehicles, frequently violating vehicles, illegal taxis, vehicles operating outside designated routes, and vehicles without proper permits for public awareness campaigns and enforcement.

5. Standing Committee of the Provincial Traffic Safety Board:

- Distribute documents citing Government Decree 86/ND-CP dated October 9, 2013, on business and business conditions for road transport by motor vehicles; Government Decree 171/2013/ND-CP dated November 13, 2013, stipulating administrative penalties for violations in the field of road and rail transport; and Circular No. 15/2014/TT-BCA dated April 4, 2014, of the Ministry of Public Security, regulating vehicle registration and management, to organizations and individuals using motor vehicles with 9 seats or more, vehicles exceeding their service life, agricultural vehicles, and self-made 3- and 4-wheeled motor vehicles, so that they are aware of and strictly comply with the law.

- Compile and provide a list of vehicles that have exceeded their service life, agricultural vehicles, homemade vehicles, vehicles that frequently violate regulations, unlicensed vehicles, vehicles operating outside designated routes, and vehicles without proper identification badges to mass media agencies for propaganda purposes.

- Regularly monitor, guide, inspect, and urge localities and units to implement the plan; periodically compile and report the results to the Provincial People's Committee, the Provincial Party Committee, and the National Traffic Safety Committee as prescribed.

Relevant provincial departments, agencies, and branches; People's Committees of districts, cities, and towns; and relevant organizations and individuals are requested to seriously implement this Directive. Monthly reports on the implementation results should be compiled and submitted to the Provincial People's Committee (through the Standing Committee of the Provincial Traffic Safety Board).
