Strengthening management of automobile transport activities
(Baonghean.vn) - The People's Committee of Nghe An province has just issued Directive No. 09/2015/CT-UBND dated March 7, 2015 on strengthening State management of automobile transportation activities in Nghe An province. The content of the directive is as follows:
In recent times, all levels, sectors and organizations have made great efforts in directing and organizing the implementation of the task of ensuring traffic order and safety, achieving many remarkable results, traffic accidents have been controlled and gradually reduced for many consecutive years. However, the traffic order and safety situation is still complicated, with a number of particularly serious traffic accidents involving homemade vehicles, vehicles that have expired their use period, vehicles not licensed to operate passenger transport (illegal vehicles)... in the province.
The main reason is that the direction and management of all levels and sectors is not drastic and thorough; some units and localities are still lax in state management of this field; the awareness of law compliance of traffic participants is still weak, intentional violations occur frequently; agricultural vehicles, homemade motor vehicles, expired vehicles that are banned from use, illegal vehicles... are still in circulation, and there are still many vehicles operating without a transport business contract badge.
To overcome the above situation, enhance the effectiveness and efficiency of state management of means of transport in the province, and continue to effectively implement Decree 86/2014/ND-CP dated September 10, 2014 of the Government on business and conditions for business of transport by automobile, Plan No. 14/KH-UBATGTQG dated January 15, 2015 on implementing work to ensure traffic order and safety in 2015, the Provincial People's Committee requests:
1. People's Committees of districts, cities and towns
- Organize a general review of all passenger cars and trucks currently operating in the management area to make a list and clearly classify the age of use of each type of vehicle, especially cars with 9 seats or more, and compile a report to the Provincial People's Committee (through the Department of Transport) before April 20, 2015.
- Direct the commune-level police where the vehicle owner resides to draw up a record requesting organizations and individuals with vehicles that have expired, farm vehicles, homemade 3-wheeled and 4-wheeled vehicles to voluntarily liquidate and destroy them; make a list of illegal passenger vehicles, fake buses, illegal taxis, and vehicles with less than 9 seats participating in transporting passengers. For vehicles that have expired, the vehicle owner must go to the Traffic Police agency to complete the procedures to revoke the vehicle registration certificate and license plate according to regulations.
- The People's Committee at the district level is responsible for supervising the general inspection of means of transport by car in the area; coordinating with the Department of Transport to strengthen transport management to prevent the operation of vehicles that have expired their use period, farm vehicles, and homemade motor vehicles. The Chairman of the People's Committee, the head of the police at the district and commune levels must be responsible if there are illegal passenger cars, vehicles without contracts, illegal bus stations, illegal bus stations, and prohibited vehicles operating in the area.

- It is strictly forbidden for organizations and individuals to make their own cars or cars-like vehicles to participate in traffic in violation of the law, affecting traffic order and safety in the area.
- Strengthen propaganda and mobilization work to encourage vehicle owners and drivers to absolutely not use expired vehicles, not to carry dangerous substances, toxic substances, flammable and explosive substances on passenger vehicles, not to violate speed, alcohol concentration, not to overload, not to carry more people than prescribed...
2.Provincial Police:
- Preside over and coordinate with the Department of Transport, People's Committees of districts, cities and towns to develop a plan to organize a general review and statistics of the number of road motor vehicles in the province, especially cars with 9 seats or more, illegal vehicles. Create a form to clearly classify the license plate and age of use for each vehicle for management.
- Direct the Road and Railway Traffic Police Department to base on the vehicle registration and management records on the list of expired cars and cars not allowed to circulate according to the law provided by the inspection agency to handle violations, revoke vehicle registration certificates and license plates according to regulations.
- Notify and guide organizations and individuals whose vehicles have expired to go to the Traffic Police to complete procedures to revoke their registration certificates and license plates. Within 15 days from the date of notification, if the vehicle owner does not voluntarily come to complete the procedures, the commune-level police will coordinate with the police to revoke the registration certificates and license plates; if they intentionally circulate, the measure of confiscating the violating vehicle will be applied according to regulations.
- Direct the force to increase patrols and control, strictly handle the intentional circulation of road motor vehicles that do not ensure technical safety, for vehicles that have expired their use period, farm vehicles, homemade vehicles, illegal vehicles... in addition to administrative sanctions, the confiscation of vehicles must be carried out according to the provisions of Point d, Clause 6, Article 16, Decree 171/ND-2013/ND-CP dated November 13, 2013 of the Government regulating sanctions for administrative violations in the field of road and railway traffic.
3. Department of Transport
- Strengthen state management of passenger transport business activities by car in the province, organize a review of enterprises and cooperatives licensed to operate passenger transport in the area to strictly manage vehicles and drivers; at the same time, notify competent authorities to handle the revocation of license plates and circulation permits for vehicles that have expired or do not meet technical safety and quality standards.
- Preside over and coordinate with the People's Committees of districts, cities and towns to review and make a list for strict management of cars with 9 seats or more and all types of trucks currently operating in the province; guide organizations and individuals who need to participate in transportation business activities to meet the business requirements and conditions as prescribed by law.
- Direct, urge and guide units and individuals doing business in automobile transportation to strictly comply with the provisions of law, regularly check the technical safety of vehicles, and immediately liquidate and destroy vehicles that do not ensure technical safety or vehicles that have expired.
- Implement the management roadmap for conditions for automobile transportation business according to the provisions of Decree 86/2014/ND-CP dated September 10, 2014 of the Government on business and conditions for automobile transportation business. Propagate and guide organizations and individuals participating in tourist transportation business activities, contracts must notify the Department of Transport of basic information of the trip including: Itinerary, number of passengers, pick-up and drop-off points, contract implementation time.
- Direct road motor vehicle inspection centers to regularly notify the police of districts, cities, towns, traffic inspectors, and road and railway traffic police departments of expired passenger cars and trucks to monitor, inspect, and handle violations according to regulations.
- Directing passenger transport enterprises and cooperatives in the province to strengthen inspection, review and terminate contracts with drivers who are not in good health, drug-addicted drivers, drivers who regularly intentionally violate traffic safety laws; organizing propaganda and education for drivers to comply with the provisions of law and transport business activities, not to transport dangerous, toxic goods, flammable, explosive substances, prohibited animals... on passenger vehicles.
- Direct the Traffic Inspectorate to strengthen inspection, examination, review and strict handling of illegal vehicles, vehicles operating on the wrong routes; vehicles that have expired; farm vehicles, homemade motor vehicles; passenger vehicles without or without route badges (signs) as prescribed, or with expired ones; transporting dangerous, toxic goods, flammable and explosive substances on vehicles; counterfeit buses competing for passengers, operating on the wrong routes; coordinate with the Traffic Police force to strictly inspect and manage vehicles with foreign license plates regarding operating conditions and intermodal licenses.
4. Department of Information and Communications; Provincial Radio and Television Station and mass media:
Strengthen the propaganda of laws on traffic safety and order; develop propaganda reports, warn about the consequences of traffic accidents caused by using expired vehicles, farm vehicles, and homemade motor vehicles. Announce the list of expired vehicles, farm vehicles, homemade vehicles, vehicles that frequently violate the law, illegal vehicles, vehicles that run on the wrong lane, and vehicles without badges for propaganda and handling.
5. Standing Committee of Provincial Traffic Safety Committee:
- Issuing documents citing Decree 86/ND-CP dated October 9, 2013 of the Government on business and conditions for business of automobile transportation; Decree 171/2013/ND-CP dated November 13, 2013 of the Government regulating administrative sanctions in the field of road and railway traffic; Circular No. 15/2014/TT-BCA dated April 4, 2014 of the Ministry of Public Security regulating vehicle registration and management to organizations and individuals using automobiles with 9 seats or more, vehicles past their expiration date, agricultural vehicles, and homemade 3- and 4-wheeled motor vehicles to strictly comply with the provisions of law.
-Synthesize and provide a list of expired vehicles, farm vehicles, homemade vehicles, vehicles that frequently violate the law, illegal vehicles, vehicles that do not run on the correct routes, and vehicles without badges to the media for propaganda purposes.
- Regularly monitor, guide, inspect and urge localities and units to implement; periodically summarize and report results to the Provincial People's Committee, Provincial Party Committee and National Traffic Safety Committee according to regulations.
Request relevant provincial departments, branches and sectors; People's Committees of districts, cities and towns; relevant organizations and individuals to seriously implement this Directive. Periodically, monthly summarize and report the implementation results to the Provincial People's Committee (through the Standing Committee of the Provincial Traffic Safety Committee).
