Spreading nails on the road can be punished with 5-12 years in prison

This is one of the new regulations proposed in D.Draft Criminal Codehas just been put out for public consultation.

Specifically, Article 270 stipulates the crime of spreading nails or sharp objects on the road, stating: Anyone who intentionally places or spreads nails or sharp objects on the road shall be subject to a fine of VND 30,000,000 to VND 100,000,000, non-custodial reform for up to 03 years, or imprisonment from 03 months to 03 years.

If the crime falls into one of the following cases, the offender shall be fined from VND 100,000,000 to VND 500,000,000 or imprisoned from 02 to 05 years: Committing the crime 02 times or more; On highways; On mountain passes, slopes or other dangerous roads; Causing death or serious damage to the health or property of others.

If the crime falls into one of the following cases, the offender shall be sentenced to imprisonment from 05 years to 12 years: Causing very serious or especially serious consequences; Dangerous recidivism.

In addition, the offender may also be fined from VND 10,000,000 to VND 50,000,000.

It is known that this is one of 20 new types of behavior, which are drafted as crimes (criminalization), to demonstrate the spirit of innovation in the concept of crime and punishment, the basis of criminal responsibility, and at the same time overcome shortcomings and limitations in the practice of fighting and preventing crime.

Recently, Prime Minister Nguyen Tan Dung has just signed Decision1076/QD-TTgpromulgate the Government's Plan on organizing public consultation on the draft Penal Code (amended).

Accordingly, the subjects of consultation include people from all walks of life in the country and Vietnamese people residing abroad.

The period for collecting public opinions on the draft Penal Code (amended) begins on July 15, 2015 and ends on September 14, 2015.
