Scattering nails on the road can result in a prison sentence of 5-12 years.

This is one of the new regulations proposed in D.Draft Criminal CodeIt has just been put forward for public comment.

Specifically, Article 270 stipulates the crime of scattering nails or sharp objects on roads, stating: Anyone who intentionally places or scatters nails or sharp objects on roads shall be fined from VND 30,000,000 to VND 100,000,000, sentenced to non-custodial correctional labor for up to 3 years, or imprisoned from 3 months to 3 years.

If the crime falls under one of the following circumstances, the penalty is a fine of VND 100,000,000 to VND 500,000,000 or imprisonment from 2 to 5 years: Committing the crime 2 or more times; On highways; On mountain passes, steep slopes, or other dangerous roads; Causing death or serious harm to the health or property of others.

If the crime falls under one of the following circumstances, the offender shall be sentenced to imprisonment from 5 to 12 years: Causing very serious or exceptionally serious consequences; Dangerous recidivism.

In addition, offenders may also be fined from 10,000,000 VND to 50,000,000 VND.

This is reportedly one of 20 new types of behavior that are being drafted as criminal offenses (criminalization), aiming to reflect a renewed understanding of crime and punishment, the basis of criminal responsibility, and to overcome shortcomings and limitations in the practical fight against crime.

Accordingly, the target group for consultation includes all segments of the population within the country and Vietnamese people residing abroad.

The period for soliciting public opinion on the draft amended Penal Code began on July 15, 2015 and ended on September 14, 2015.
