The Government has just issued Decree No. 23/2016/ND-CP on construction, management and use of cemeteries and crematoriums.

Accordingly, cremation service users are supported with cremation costs, transportation costs and other costs.
Also according to the provisions of the above Decree, all cemeteries and crematoriums must be planned. The planning and investment in the construction of cemeteries and crematoriums must comply with the laws on planning, construction and environmental protection. The construction or expansion of cemeteries and crematoriums must comply with the construction planning and cemetery planning of the province approved by the competent authority.
Cemeteries with technical infrastructure, landscape and environment that are not in accordance with current technical standards and regulations in accordance with construction planning and provincial cemetery planning shall be renovated by the locality. Cemeteries must be closed when they no longer have usable area, cause environmental pollution and follow the construction planning or provincial cemetery planning approved by competent authorities.
The State encourages investment in the construction of cemeteries and crematoriums to serve many localities, using new, civilized and modern burial methods to maximize land and construction costs and ensure environmental requirements and surrounding landscapes.
The Decree also stipulates that burials must be carried out in cemeteries. In case of burials in the grounds of churches, pagodas, and religious temples, environmental hygiene must be ensured and approved by the People's Committees at all levels according to the decentralization of the Provincial People's Committee. Burials must be in accordance with beliefs, good customs, practices, cultural traditions, and modern civilized lifestyles.
At the same time, the Decree also stipulates the maximum land area for each individual grave. Specifically, the land area for each burial grave and single burial grave must not exceed 5 square meters. The land area for each sand burial grave must not exceed 3 square meters.
According to the provisions of the Decree, social protection beneficiaries upon death are supported with funeral expenses according to current regulations./.
