The government has recently issued Decree No. 23/2016/ND-CP on the construction, management, and use of cemeteries and crematoriums.

Accordingly, those using cremation services will receive support for cremation costs, transportation costs, and other expenses.

According to the aforementioned Decree, all cemeteries and crematoriums must be planned. The planning and construction of cemeteries and crematoriums must comply with the laws on planning, construction, and environmental protection. The construction of new or the expansion of existing cemeteries and crematoriums must comply with the construction plan and the regional cemetery plan approved by the competent authority.

Cemeteries with inadequate infrastructure, landscaping, and environmental conditions that do not meet current technical standards and regulations, and which are consistent with the provincial construction and cemetery planning, shall be renovated by the local authorities. Cemeteries must be closed when they no longer have usable space, cause environmental pollution, and in accordance with the construction or provincial cemetery planning approved by the competent authority.

The State encourages investment in the construction of cemeteries and crematoriums to serve many localities, using new, civilized, and modern burial methods to maximize land and construction cost savings while ensuring environmental and landscape requirements are met.

The decree also stipulates that burials must be carried out in cemeteries. In cases where burials take place within the grounds of churches, temples, or religious sanctuaries, environmental hygiene must be ensured and approval obtained from the People's Committees at the appropriate levels, as delegated by the provincial People's Committees. Burials must be in accordance with good beliefs, customs, traditions, cultural heritage, and modern civilized lifestyles.

At the same time, the Decree also stipulates the maximum land area for each individual grave. Specifically, the land area for each grave for burial and single interment shall not exceed 5m2. The land area for each grave for cremation shall not exceed 3m2.

According to the Decree, social welfare beneficiaries who die will receive funeral expense support in accordance with current regulations.
