On the morning of October 26th, continuing the work program of the 2nd Session of the 14th National Assembly, delegates discussed in the plenary hall the draft Law amending and supplementing a number of articles of the Penal Code.

Speaking to reporters on the sidelines of the National Assembly, the delegates said that this is a very important law.

National Assembly Deputy Nguyen Thi Xuan (Dak Lak Delegation) stated: The Criminal Code is a major and very important law; it is the legal basis for protecting national sovereignty, national interests and security, citizens' rights, and the equality of all citizens. Furthermore, it serves as a foundation for educating citizens on the importance of complying with the law.

The criminal code plays a particularly important role in the fight against crime; any errors in it would have serious consequences.

Representative Nguyen Thi Xuan stated: "I agree with Option 2 of the Legal Committee's review report, which is that we need to rectify as many errors in the law as possible. We should even thoroughly and comprehensively amend unreasonable provisions."

A law, once enacted, must ensure high feasibility, be practical, and have long-term stability. If there are still shortcomings, further improvements and additions will be made, and only when the draft law is truly good and of high quality will it be passed.”

The draft law adds a provision allowing for the determination of the drug's content to determine its mass or volume, which serves as the basis for criminal prosecution. According to National Assembly Deputy Nguyen Huu Cau from Nghe An province, this provision is not in line with reality.

Mr. Cau said: "I only agree that there are 4 cases that require examination: dissolved solid drugs, diluted liquid drugs, opium residue, and precursors and psychotropic substances."

This field of expert examination falls under the purview of criminal procedural agencies, meaning it pertains to procedural law rather than substantive law, so we shouldn't include it here. If there are any amendments, they should be included in procedural law, which is the Criminal Procedure Law.”

Meanwhile, National Assembly Deputy Bui Van Phuong (Ninh Binh delegation) suggested that: Focus should be placed on correcting technical errors or inconsistencies that have already received inter-ministerial consensus. Other errors can be discussed further if time permits.
