Establish a strong legal framework to prevent the loss and waste of public assets.

(Baonghean.vn) - Amending several articles in the Draft Law on the Management and Use of Public Assets is necessary to establish a legal basis for strict management and economical use of public assets, preventing and combating loss and waste.

This was the content of the conference to provide feedback on the draft Law on the Management and Use of Public Assets, organized by the Provincial National Assembly Delegation on the morning of March 22nd.

The draft Law comprises 10 chapters with 136 articles regulating state management of public assets and the duties and powers of state agencies regarding public assets; management and use of public assets in agencies, organizations, and enterprises; management and use of infrastructure assets; exploitation of financial resources, land, and natural resources; and services related to public assets.

At the conference, the majority of delegates agreed that amending several articles in the Draft Law on the Management and Use of Public Assets is necessary to establish a legal basis for strict management and economical use of public assets, and to prevent and reduce losses and waste.

Essentially, the provisions of the Draft Law on the Management and Use of Public Assets are consistent with the Party's guidelines, policies, and principles; and address the shortcomings and limitations in the implementation of the current Law on the Management and Use of State Assets. The majority of delegates agreed on the necessity of amending the current title "Law on the Management and Use of State Assets" to "Law on the Management and Use of Public Assets".

Delegates contributed additional opinions to the provisions, focusing on key issues: the concept of public assets; principles of managing and using public assets; the regime for managing and using public assets in agencies, organizations, and units; management of special assets and specialized assets in units of the People's Armed Forces; maintenance and upkeep of infrastructure assets, etc.

Specifically, regarding Article 1 - Explanation of the Law's Concept, opinions agree with the content that "Public property is property owned by the entire people, with the State acting as the representative owner and managing it uniformly."

In addition, many delegates argued that the Law should only cover assets that are manageable, and should not regulate assets that are not manageable. They also suggested that funds belonging to the state budget, state financial funds, and foreign exchange funds should not be excluded from the concept of public assets.

In Article 2, suggestions were made to add units of the People's Armed Forces, Vietnamese agencies abroad, and project management boards using state capital to the scope of application.

In Section 2, Chapter III, which regulates the standards and norms for the use of public assets in agencies, organizations, and units, many opinions suggest the need for specific and clear regulations to ensure fairness, equality, and consistent application of standards and norms for the use of public assets. They also propose the introduction of fixed quotas and detailed regulations on specific items such as those related to the construction of office buildings, job titles for using official vehicles, vehicle values, and office room standards.

For example, regarding Article 33, which regulates the allocation of funds for the use of public assets in state agencies, delegates suggested that specific regulations should be included in the mechanism for applying the allocation of funds for official vehicles, the applicable subjects, the method of calculating the allocation amount, and the time of application.

At the conclusion of the conference, on behalf of the Provincial National Assembly Delegation, Comrade Nguyen Thanh Hien acknowledged and highly appreciated the contributions and suggestions from the delegates. These suggestions will be compiled by the Provincial National Assembly Delegation and submitted to the Standing Committee of the National Assembly in the near future.
