On May 15, 2017, the Investigation Police Department of Nghe An province arrested Hoang Duc Binh (born February 10, 1983, in Hung Trung commune, Hung Nguyen district, Nghe An province) on charges of "Resisting public officials; abusing democratic freedoms to infringe upon the interests of the State, the legitimate rights and interests of organizations and citizens," as stipulated in Articles 257 and 258 of the Penal Code, for investigation and legal processing.
Initial verification revealed that Hoang Duc Binh committed the following violations: While living and working in Ho Chi Minh City, Binh participated in several anti-government organizations and groups, such as "NoU Saigon" and "Vietnamese Labor Movement". On December 25, 2015, Hoang Duc Binh distributed leaflets in Ho Chi Minh City and was detained by the Ho Chi Minh City Police for 24 hours for investigation into the act of distributing leaflets to recruit people to join the "Independent Trade Union"; he was fined 24,000,000 VND for violating regulations on the storage and distribution of publications and printed products that are not publications (Article 27, Decree 159/ND-2013 dated November 12, 2013 of the Government on administrative penalties in the field of journalism and publishing), but Binh did not pay the fine and fled to Nghe An.

After returning to Nghe An, Hoang Duc Binh frequently posted and shared on his personal Facebook account information and documents that slandered the regime and promoted pluralism and a multi-party system. Taking advantage of the environmental disaster in the Central coastal region, in his capacity as Vice Chairman of the "Vietnamese Labor Movement," Hoang Duc Binh initiated and established the "Central Fishermen's Association" with the intention of creating an external organization, gathering forces, and attracting Catholic parishioners and fishermen in the Central region to join the organization; and selecting "key figures" to incite protests and disrupt public order and security.
Hoang Duc Binh, along with several extremist priests such as Dang Huu Nam and Nguyen Dinh Thuc, repeatedly incited parishioners to the Ky Anh Town People's Court to file lawsuits against Formosa, but in reality, they were causing disturbances and disrupting public order and security. Binh purchased high-powered loudspeakers to equip these public disturbances, filmed them, and disseminated the footage online, distorting the truth to incite people to oppose the government.
For example, on April 2, 2017, Hoang Duc Binh and Bach Hong Quyen (born August 17, 1989, from Coi village, An Do commune, Binh Luc district, Ha Nam province, currently wanted nationwide by the Criminal Investigation Agency of the Ha Tinh Provincial Police for disturbing public order) incited people in Trung Nghia parish (Thach Bang, Loc Ha, Ha Tinh) to surround and attack a patrol team of the Loc Ha District Police and the Thach Bang Commune Police, injuring one police officer; they also surrounded and vandalized the house of the head of the Thach Bang Commune Police, and marched to the Loc Ha District Police headquarters and the Loc Ha District People's Committee, causing a disruption of public order and security.
Based on the investigation results, on May 11, 2017, the Criminal Investigation Department of the Nghe An Provincial Police issued Decision No. 04/PC44 to initiate criminal proceedings for the acts of "disrupting public order; resisting public officials; abusing democratic freedoms to infringe upon the interests of the state, the legitimate rights and interests of organizations and citizens; and destroying or intentionally damaging property."
On the same day, the Investigation Police Department of Nghe An province issued a decision to prosecute and arrest Hoang Duc Binh for the crime of "Resisting public officials; Abusing democratic freedoms to infringe upon the interests of the state, the legitimate rights and interests of organizations and citizens" as stipulated in Articles 257 and 258 of the Penal Code.

The execution of the arrest warrant was carried out in accordance with the provisions of the Criminal Procedure Code, with the participation of a representative from the People's Procuracy of Nghe An province and the presence of relevant individuals.
