On May 15, 2017, the Investigation Police Agency of Nghe An Provincial Police arrested Hoang Duc Binh (born February 10, 1983, in Hung Trung Commune, Hung Nguyen District, Nghe An Province) for the crime of "Resisting a person on official duty; Abusing democratic freedoms to infringe upon the interests of the State, the legitimate rights and interests of organizations and citizens", as prescribed in Articles 257 and 258 of the Penal Code for investigation and handling according to the law.
Through initial verification, Hoang Duc Binh had committed the following violations of the law: During his time living and working in Ho Chi Minh City, Binh participated in a number of organizations, associations, and opposition groups, such as "NoU Saigon", "Vietnam Labor Movement". On December 25, 2015, Hoang Duc Binh distributed leaflets in Ho Chi Minh City and was temporarily detained by Ho Chi Minh City Police for 24 hours to investigate the act of distributing leaflets to attract people to join the "Independent Union"; was fined 24,000,000 VND for violating regulations on storing, distributing publications and printed products that are not publications (Article 27, Decree 159/ND-2013 dated November 12, 2013 of the Government regulating administrative sanctions in the field of press and publishing), but Binh did not pay the fine and fled to Nghe An.

After returning to Nghe An, Hoang Duc Binh frequently posted and shared on his personal Facebook information and propaganda documents that slandered the regime and promoted the movement for pluralism and multi-partyism. Taking advantage of the environmental incident in the central coastal region, as Vice President of the “Vietnamese Labor Movement”, Hoang Duc Binh promoted and established the “Central Fishermen’s Association” with the intention of creating a peripheral organization, gathering forces, attracting Catholics and fishermen from the central region to join the organization; searching for a “nucleus” to incite protests and disrupt security and order.
Hoang Duc Binh has repeatedly joined a number of extremist priests such as Dang Huu Nam and Nguyen Dinh Thuc in luring parishioners into the Ky Anh Town People's Court to file a lawsuit against Formosa, but in reality, it was to cause disturbances and affect public order and security. Binh bought high-powered speakers to equip himself for public disturbances, filmed them, distributed them online, and distorted the truth to incite people to oppose the government....
Typically, on April 2, 2017, Hoang Duc Binh and Bach Hong Quyen (born August 17, 1989, from Coi village, An Do commune, Binh Luc district, Ha Nam province, the subject is currently wanted nationwide by the Investigation Police Agency of Ha Tinh province for disturbing public order), incited people of Trung Nghia parish (Thach Bang, Loc Ha, Ha Tinh) to surround and attack the patrol team of Loc Ha district police and Thach Bang commune police, injuring one police officer; surrounded and destroyed the property of the head of Thach Bang commune police, dragged them to the headquarters of the district police and the People's Committee of Loc Ha district, causing disorder and insecurity.
Based on the investigation results, on May 11, 2017, the Investigation Police Agency of Nghe An Public Security issued a decision to prosecute case No. 04/PC44 on the acts of "disturbing public order; resisting people on official duty; taking advantage of democratic freedoms to infringe upon the interests of the State, the rights and legitimate interests of organizations and citizens; destroying or intentionally damaging property".
On the same day, the Investigation Police Agency of Nghe An Province issued a Decision to prosecute the accused; issued an arrest warrant for Hoang Duc Binh to temporarily detain and investigate for the crime of "Resisting a person performing official duties; Taking advantage of democratic freedoms to infringe upon the interests of the State, the legitimate rights and interests of organizations and citizens" as prescribed in Articles 257 and 258 of the Penal Code.

The organization of the execution of the arrest warrant must comply with the provisions of the Criminal Procedure Code, with the participation of representatives of the People's Procuracy of Nghe An province and the witness of relevant persons.
