Commune considers granting land to martyr's wife, son continuously refuses

(Baonghean)- Mr. Nguyen Cong Kinh (Hamlet 4, Tan Son Commune, Do Luong, Nghe An) continuously refused the State's attention to his martyr's wife and left his mother in an illegally built hut.

For more than 2 years now, people in Tan Son commune (Do Luong) have been feeling sorry for the family situation of Mrs. Thai Thi Than (85 years old, hamlet 4, Tan Son commune). Despite her old age and weak health, Mrs. Than has to live every day in a thatched hut of about 10 square meters, which is tattered, shabby and extremely cramped. The hut is surrounded by a shabby tarpaulin, which leaks in all directions in the rainy season and is hot in the summer.

About 30 meters away is the solid, spacious, roofed house of her son - Mr. Nguyen Cong Kinh.

No cooperation with the authorities

Immediately after learning about Mr. Kinh's arbitrary tent-building on the collective land, the People's Committee of Tan Son commune, along with other departments and organizations, came to persuade and persuade Mr. Kinh to dismantle the tent and bring Mrs. Than home to ensure her health. However, Mr. Kinh ignored them and did not comply. Mr. Kinh said that in 2006, the commune had let his mother draw lots for the plot of land where he was building the tent, so now he only receives land there.

Comparing with the State's regulations on land through the periods and the remaining records, it can be affirmed that the State has not had any official document granting land to Ms. Than in the old elementary school area. In 2006, it is true that Tan Son commune allowed Ms. Than and another family to draw lots for land in the above area. However, when the commune submitted the documents to the District People's Committee requesting approval to grant land to Ms. Than in the form of valuation, Do Luong district did not agree.

According to Mr. Nguyen Trong Hoi - Deputy Head of the Department of Natural Resources and Environment of Do Luong district, in 2006, the process of considering land allocation for policy beneficiaries was not properly implemented by the People's Committee of Tan Son commune. Moreover, at that time, Ms. Thai Thi Than was not eligible for land allocation and valuation according to Decision 39/2005/QD-UB dated March 21, 2005 of the Provincial People's Committee. Specifically, Ms. Than had land before and was later granted a land use right certificate by the State to her son - Mr. Nguyen Cong Kinh.

Furthermore, the land of the old primary school in Hamlet 4 was approved by the District People's Committee in 2006 for detailed land subdivision and auction. The land plot that Ms. Than drew lots for is land with profitable value, not included in the land fund considered for allocation according to Decision 38/2005/QD-UB dated March 18, 2003 of the Provincial People's Committee.

Although the authorities at all levels have explained many times, Mr. Kinh did not listen. After many unsuccessful attempts to persuade Mr. Kinh to dismantle the tent himself, on March 27, 2017, the People's Committee of Tan Son commune made a record of administrative violations in the field of land against Mr. Kinh for the act of arbitrarily setting up tents on collective land. In the following days, the commune authorities continuously issued invitations, summoning Mr. Kinh to work, but he did not come.

Mr. Nguyen Ba Tan - Chairman of Tan Son Commune People's Committee said: The commune has invited Mr. Kinh to work many times, with the participation of leaders of Do Luong District People's Committee, but Mr. Kinh did not cooperate many times. There was a meeting where he said a few words and then left halfway.

Deny mother's rights

With preferential policies for people with revolutionary contributions, in recent times, the People's Committee of Tan Son commune has often paid attention to people like Ms. Than. Immediately after the Provincial People's Committee issued Decision 78/QD-UBND on land allocation without auctioning land use rights, considering the family's wishes, in July 2016, the People's Committee of the commune invited Mr. Kinh (representing Ms. Than) to the People's Committee of the commune to guide the procedures for requesting land allocation in the form of land use rights valuation in the Cay Troi area (Hamlet 3, Tan Son commune) for Ms. Than.

However, Mr. Kinh did not cooperate with the procedures as instructed and did not accept the land allocation in the Cay Troi area. He insisted that the State allocate land in the old elementary school area in hamlet 4 for his mother.

Realizing that Mrs. Than was old and considering Mr. Kinh's wishes, the Commune People's Committee prepared a report to the District People's Committee requesting to adjust the detailed subdivision planning of the old elementary school area from residential land in the form of auction to residential land in the form of valuation.

Not long after that, the People's Committee of Do Luong district agreed to change and supplement the planning from 4 auctioned lots to 6 appraised lots. After completing the procedures, the People's Committee of the commune and the departments and branches of Do Luong district continued to invite Mr. Kinh to guide the procedures for requesting land allocation in the form of appraising the old primary school area for Ms. Than.

Accordingly, Mr. Kinh will be able to choose 1 of 6 plots of land and the State will mobilize social resources to build a house of gratitude for his mother. But once again, the State's concern for Mrs. Than was rejected by Mr. Kinh himself. Meanwhile, his mother herself is the policy subject that the State cares for and helps, not him.

Many people doubt whether Mr. Kinh intentionally did not accept the land for other purposes and not for his mother's benefit. Because the 6 plots of land that the Commune People's Committee gave the family to choose are located on flat, spacious land, with convenient traffic and only 5m from Mr. Kinh's house.

"Mr. Kinh's failure to cooperate with the commune to complete the procedures for considering the request for land allocation based on valuation is a denial of his mother's rights and the State's attention to policy beneficiaries who have contributed to the revolution," said Mr. Nguyen Trong Hoi - Deputy Head of the Department of Natural Resources and Environment of Do Luong district.

It is known that on March 8, 2017, the People's Committee of Do Luong district issued a decision to enforce the decision to sanction administrative violations against Mr. Kinh. The reason is that Mr. Kinh did not comply with effective remedial measures due to the violation of illegally setting up tents on collective land. However, due to Ms. Than's health condition, the enforcement has not been carried out.

Therefore, Mr. Kinh's request is unfounded and he should cooperate with the government to be guided in the procedures for land allocation in the form of valuation for his mother. Currently, his mother is also old and in poor health, so having a house soon is urgent.

For the People's Committee of Tan Son commune, it is necessary to clarify and have a serious form of review for the officials who organized the land draw against the procedure and wrong subjects for Ms. Than in 2006. Only then, the matter will be resolved soon, creating conditions for Ms. Than to soon stabilize her life.
