The commune is considering allocating land to the widow of a fallen soldier, but the son repeatedly refuses.
(Baonghean) - Mr. Nguyen Cong Kinh (Hamlet 4, Tan Son Commune, Do Luong District, Nghe An Province) has repeatedly refused the State's support for the widow of a fallen soldier, leaving his mother in an illegally constructed shack.

For over two years, the people of Tan Son commune (Do Luong district) have been saddened by the plight of Mrs. Thai Thi Than (85 years old, Hamlet 4, Tan Son commune). Despite her advanced age and frail health, Mrs. Than has to live daily in a dilapidated, cramped shack of about 10 square meters. The shack is covered with flimsy tarpaulin, leaking everywhere during the rainy season and unbearably hot in the summer. Non-cooperative with the authorities
Immediately after learning that Mr. Kỉnh had arbitrarily erected a tent on communal land, the People's Committee of Tân Sơn commune, along with various departments and organizations, tried to persuade and encourage Mr. Kỉnh to dismantle the tent himself and bring Mrs. Thân home to ensure her health. However, Mr. Kỉnh ignored their pleas and refused to comply. He claimed that in 2006, the commune had allowed his mother to win the land plot where he was erecting the tent through a lottery, so he now only claimed ownership of that land.

Comparing this with the State's land regulations throughout different periods and the archived records, it can be confirmed that the State has never officially granted land to Ms. Than in the area of the former primary school. In 2006, it is true that Tan Son commune allowed Ms. Than and another family to draw lots for land in that area. However, when the commune submitted the application to the District People's Committee requesting approval for land allocation to Ms. Than through valuation, Do Luong district did not agree.
According to Mr. Nguyen Trong Hoi, Deputy Head of the Department of Natural Resources and Environment of Do Luong District, in 2006, the process of allocating land to policy beneficiaries was not properly implemented by the Tan Son Commune People's Committee. Furthermore, at that time, Ms. Thai Thi Than was not eligible for land allocation based on valuation according to Decision 39/2005/QD-UB dated March 21, 2005, of the Provincial People's Committee. Specifically, Ms. Than already owned land before, and later the State granted a land use right certificate to her son, Mr. Nguyen Cong Kinh.
Furthermore, the land where the old primary school was located in Hamlet 4 was approved by the District People's Committee in 2006 for detailed land subdivision and auction. The plot of land that Ms. Than won in the lottery is valuable land with potential for profit and is not included in the land allocated under Decision 38/2005/QD-UB dated March 18, 2003, of the Provincial People's Committee.

Despite repeated explanations from authorities, Mr. Kỉnh refused to listen. After numerous unsuccessful attempts to persuade him to dismantle the structure himself, on March 27, 2017, the Tan Son Commune People's Committee issued an administrative violation report against Mr. Kỉnh for illegally erecting a tent on communal land. In the following days, the commune authorities repeatedly sent summonses to Mr. Kỉnh, but he did not appear.
Mr. Nguyen Ba Tan, Chairman of the Tan Son Commune People's Committee, said: "The commune has invited Mr. Kinh to work with us many times, with the participation of leaders from the Do Luong District People's Committee, but Mr. Kinh has repeatedly refused to cooperate. On some occasions, he would only say a few words before leaving midway through the meeting."
Denying a mother's rights
In line with preferential policies for those who have rendered meritorious services to the revolution, the People's Committee of Tan Son commune has consistently shown concern for individuals like Ms. Than. Immediately after the Provincial People's Committee issued Decision 78/QD-UBND regarding the allocation of residential land without auctioning land use rights, and considering the family's wishes, in July 2016, the People's Committee of the commune invited Mr. Kinh (representing Ms. Than) to the People's Committee office to guide her through the procedures for requesting residential land allocation based on land use rights valuation in the Cay Troi area (Hamlet 3, Tan Son commune).

However, Mr. Kỉnh did not cooperate with the procedures as instructed and refused to be allocated land in the Cây Trôi area. He insisted that the State allocate land to his mother in the area of the old primary school in Hamlet 4.
Recognizing Mrs. Than's advanced age and considering Mr. Kinh's wishes, the Commune People's Committee submitted a proposal to the District People's Committee requesting an adjustment to the detailed land subdivision plan for the former primary school area, changing it from residential land auctioned to residential land appraised.
Shortly afterwards, the People's Committee of Do Luong District agreed to change and supplement the planning from 4 auctioned land plots to 6 appraised land plots. After completing the procedures, the People's Committee of the commune and the departments and agencies of Do Luong District continued to invite Mr. Kinh to guide the process of applying for land allocation for residential purposes in the form of appraised land in the area of the former primary school for Ms. Than.
Accordingly, Mr. Kỉnh would be able to choose one of six plots of land, and the State would mobilize social resources to build a charitable house for his mother. But once again, Mr. Kỉnh rejected the State's concern for Mrs. Thân. Meanwhile, his mother herself was the one who should be receiving the State's attention and assistance, not him.
Many people suspect that Mr. Kỉnh deliberately refused the land for other reasons, not for his mother's benefit. After all, the six plots of land that the commune's People's Committee allowed the family to choose were located on flat, spacious land with convenient transportation and were only 5 meters away from Mr. Kỉnh's house.
"Mr. Kỉnh's failure to cooperate with the commune in processing the land allocation application through valuation is a denial of his mother's rights and a rejection of the State's concern for those who have rendered meritorious service to the revolution," said Mr. Nguyen Trong Hoi, Deputy Head of the Department of Natural Resources and Environment of Do Luong District.

It is known that on March 8, 2017, the People's Committee of Do Luong District issued a decision to enforce the administrative penalty decision against Mr. Kinh. The reason was that Mr. Kinh did not comply with effective remedial measures due to his violation of arbitrarily erecting tents on collective land. However, due to Mrs. Than's health condition, the enforcement has not yet been carried out.
Therefore, Mr. Kỉnh's request is unfounded, and he should cooperate with the authorities to receive guidance on the procedures for granting land to his mother through a valuation process. Currently, his mother is elderly and in poor health, so having a house as soon as possible is urgent.
The Tan Son Commune People's Committee needs to clarify and seriously reprimand the officials who organized the land lottery for Ms. Than in 2006 in violation of procedures and targeting the wrong individuals. Only then will the matter be resolved definitively, allowing Ms. Than to stabilize her life as soon as possible.
