On December 17, 2017, at the Party Central Committee Headquarters, the Secretariat met under the chairmanship of General Secretary Nguyen Phu Trong.

After considering the proposal of the Central Inspection Commission in Submission No. 86-TTr/UBKTTW, dated December 16, 2017, on the proposal to discipline the Standing Committee of Vinh Phuc Provincial Party Committee for the 2010-2015 term and comrade Pham Van Vong, former member of the Party Central Committee, Secretary of the Provincial Party Committee for the 2010-2015 term, Chairman of the People's Council of Vinh Phuc province for the 2011-2016 term; Submission No. 87-TTr/UBKTTW, dated December 16, 2017 on the proposal to discipline comrade Ngo Van Tuan, member of the Provincial Party Committee, Vice Chairman of the Provincial People's Committee, former Secretary of the Party Committee, former Director of the Department of Construction of Thanh Hoa province, the Secretariat found that:


I- The Standing Committee of Vinh Phuc Provincial Party Committee for the 2010-2015 term and comrade Pham Van Vong committed the following violations:

1- Violations of the Standing Committee of Vinh Phuc Provincial Party Committee

(a) Violation of the principles of organizing party activities and working regulations

Violating Regulation No. 51-QD/TW, dated April 19, 2007 of the Secretariat on the tasks and working relationships of the Standing Committee of the Provincial Party Committee and the City Party Committee in advising the Provincial Party Committee to promulgate Working Regulations, including regulations authorizing the Standing Committee of the Provincial Party Committee to consider and resolve a number of socio-economic issues beyond its authority; limiting the role and responsibility of the Standing Committee of the Provincial Party Committee in leadership and direction.

(b) Violating the principle of democratic centralism and the Party and State's regulations on organization and personnel work, the decision to appoint and recommend candidates for many cadres did not meet the prescribed standards and conditions, and showed signs of localism, favoritism, and abnormality. The cadre planning under the management of the Provincial Party Committee Standing Committee had many cases that were not in accordance with regulations; no plan for cadre rotation was developed. Lack of inspection and supervision led to a number of agencies and organizations having the number of departments, the number of deputy leaders of departments and branches, and using contract labor not in accordance with regulations.

(c) Violations in leadership and direction of land management and use and investment management in construction of a number of key projects and works. Violations of the Provincial Party Committee's Working Regulations, the Provincial Party Committee's Standing Committee approved policies for many investment projects that used land beyond their authority, inconsistent with planning, and not in accordance with legal regulations; land allocation without auctioning land use rights, causing loss of state budget. Lax leadership and lack of inspection allowed the Provincial People's Committee to violate state management of a number of key projects and works, causing serious consequences.

2- Comrade Pham Van Vong, former member of the Party Central Committee, Secretary of the Provincial Party Committee for the 2010-2015 term, Chairman of the People's Council of Vinh Phuc province for the 2011-2016 term, committed the following violations:

As the leader, he is primarily responsible for the violations and shortcomings of the Provincial Party Committee Standing Committee for the 2010-2015 term. Violating the principle of democratic centralism, the Provincial Party Committee's Working Regulations and the Party and State's regulations in deciding to appoint a number of officials who did not ensure principles, conditions and standards. Chairing the Provincial Party Committee Standing Committee's meeting to approve many projects that used land in violation of regulations; lacking attention to inspection and supervision, allowing the Provincial People's Committee to commit serious violations in the management of investment in construction of a number of key projects and in the management and use of land.

The Secretariat found that the violations and shortcomings of the Standing Committee of the Vinh Phuc Provincial Party Committee for the 2010-2015 term and comrade Pham Van Vong were serious, negatively affecting the reputation of the Party organization and the individual.

Pursuant to Regulation No. 263-QD/TW and Regulation No. 102-QD/TW of the Politburo on disciplinary action against violating Party organizations and Party members, the Secretariat decided to discipline the Standing Committee of Vinh Phuc Provincial Party Committee for the 2010-2015 term with a warning; and to discipline comrade Pham Van Vong by removing him from the position of Provincial Party Secretary for the 2010-2015 term.

II- Party disciplinary action against comrade Ngo Van Tuan, member of the Provincial Party Committee, Vice Chairman of the Provincial People's Committee, former Party Secretary, former Director of the Department of Construction of Thanh Hoa province

Comrade Ngo Van Tuan has the following violations:

From October 2010 to November 2015, in his position as Party Secretary and Director of the Department of Construction, he violated the principle of democratic centralism and violated the Party and State regulations on organization and personnel work, specifically:

- Intentionally violating the regulations of the Thanh Hoa Provincial Civil Servant Recruitment Council in 2011; issuing a decision to establish a Council for selecting cadres and civil servants of the Department of Construction without proper authority in order to favor and support in receiving, transferring and appointing Ms. Tran Vu Quynh Anh from a contract worker to a professional civil servant; in a very short time after that, appointed her as Deputy Head of Department, Head of Department; proposed to plan the position of Deputy Director of the Department and admit her to the Party, join the Party Committee of the Department of Construction for Ms. Tran Vu Quynh Anh against regulations.

- Issuing decisions on standards for appointing officials without proper authority, violating standards for officials prescribed by competent authorities; appointing many department heads and deputy department heads who do not meet the conditions and standards, in which the typical case is Ms. Tran Vu Quynh Anh.

- The decision to establish a number of new units under the Department of Construction was beyond its authority, violating Party and State regulations on administrative reform, streamlining of organizational structure and staffing.

Comrade Ngo Van Tuan's violations and shortcomings are very serious, repeated, systematic, and involve a number of Party organizations and many Party members, requiring disciplinary action. During the review process, he did not seriously self-criticize and did not sincerely admit his shortcomings and violations. Based on the content, nature, level of influence and consequences of the violations, and based on Decision 102 of the Politburo on handling Party members who violate, the Secretariat decided to discipline Comrade Ngo Van Tuan by removing him from all positions in the Party.
