Prime Minister's working group announces progress in cutting procedures of each ministry
According to the Prime Minister's Working Group, the reduction of procedures related to specialized inspections has not been resolutely implemented by the Ministries. Therefore, the results as required by the Government and the Prime Minister have not been achieved.
The Prime Minister's working group has just reported on the results of implementing tasks assigned by the Government and the Prime Minister and the inspection results in February 2018.

In February, the Prime Minister's Working Group inspected 16 ministries and agencies in reducing the list of products and goods, simplifying specialized inspection procedures (KTCN) and reducing business conditions.
Ministries have not yet drastically cut down on technical inspection procedures
The inspection results show that in recent times, specialized inspection work has had positive changes, in the right direction according to the direction of the Government and the Prime Minister.
However, the reduction of procedures related to technical regulations has not been resolutely implemented by the Ministries. Therefore, the results as required by the Government and the Prime Minister have not been achieved.
The Ministries have not yet proposed specific management methods for the lists of goods subject to technical inspections, which are overlapping and subject to many forms of inspection by many Ministries or by many agencies and units under one Ministry.
The monopoly in conformity assessment and inspection activities has not been completely overcome. The cost of technical inspection procedures remains a heavy burden for businesses...

Many general, imposed regulations
The results of the inspection of business conditions show that there are currently 243 investment and business sectors with 3,571 requirements and conditions. On average, there are about 14 requirements and conditions applied to each investment and business sector in different fields. Business conditions are stipulated in 237 legal documents, including 66 laws, 3 ordinances, and 162 decrees.
Many industries and occupations in the List of Conditional Investment and Business Industries do not really meet the criteria stipulated in the Investment Law 2014 on the necessity of being defined as conditional investment and business industries and occupations. Some investment and business conditions set out requirements that are excessive to serve state management requirements, creating barriers to market entry and limiting competition.
Many business investment conditions are stipulated in general terms, unclear, lacking specificity, and difficult to determine, such as: "must be suitable", "must be sufficient", "must be clean", "must be airy", "must be convenient", "must have good morals", "must be in good health", "must have qualifications"...
Some business investment conditions impose rigid business methods, interfere too deeply with the autonomy of enterprises in organizing production and business, causing adverse impacts on small and medium enterprises, such as requiring the establishment of a specific type of enterprise; requiring business in a certain way; must be consistent with industry and product planning; must have a minimum premises, scale, production and business capacity or must use a certain type of technology...

Absolutely do not "cut this to add that"
From January 1, 2017 to February 28, 2018, there were a total of 25,385 tasks assigned by the Government and the Prime Minister to ministries, agencies and localities. Of these, 13,311 tasks were completed (on time: 11,148, overdue: 2,163); 12,074 tasks were not completed (on time: 11,765,Overdue: 309 - accounting for 2.26%). |
Based on the results of working with Ministries and agencies, the Working Group recommended to the Government and the Prime Minister to direct Ministries and agencies to review all legal documents, propose to abolish and amend overlapping, inconsistent and unreasonable regulations on technical inspection and business conditions that hinder production and business activities of enterprises in order to ensure the reduction and simplification of 50% of the list of goods, technical inspection procedures and conditions in the direction of building 1 Decree amending many Decrees according to shortened procedures, and report to the Government in the second quarter of 2018.
Develop a specific roadmap and plan for reductions and ensure that the reductions, amendments or abolitions must be substantial, not purely mechanical, combining many conditions into one condition; absolutely do not reduce or abolish one thing and add another, or amend or reduce by changing the name.
Urgently develop plans to reduce and abolish unnecessary and unreasonable business conditions and administrative procedures that cause difficulties and hinder the production and business activities of people and enterprises. From March 15, the Working Group will conduct inspections on the reduction and abolition of business conditions and administrative procedures at ministries, agencies and localities.
Urgently issue a list of goods subject to technical inspection with HS codes (there are still 42 lists of goods that have not been issued) under the scope of specialized management. Complete the issuance of technical standards and regulations for the list of goods subject to technical inspection upon import at the customs clearance stage to facilitate the application of risk management (about 34% of the list of goods subject to technical inspection do not have technical standards and regulations).
For the Ministry of Planning and Investment, urgently develop a draft Law amending and supplementing a number of articles of the Investment Law and the Enterprise Law, including studying the reduction of 30-50% of unnecessary business conditions under management in Appendix 01 of the Investment Law.
The Government Office shall preside over working with specialized management ministries to propose specific methods of management and inspection for the list of goods that are overlapping and subject to many forms of management and inspection by many ministries or agencies and units under one ministry in the direction that one item is only regulated by one document and the ministry or agency responsible for management and inspection.
