Have a master's degree, get an extra salary step?

Ms. Hoang My Linh got her master's degree in 2015 and applied for the position of specialist of the District Farmers' Association (in Hanoi) with a requirement of university degree or higher. After passing the exam, she was assigned a salary level 1, coefficient 2.34. So, does Ms. Linh receive a salary level 1 or a salary level 2 equivalent to a master's degree?

Regarding this issue, Lawyer Tran Van Toan, Khanh Hung Law Office, Hanoi Bar Association responded as follows:

Clause 3, Article 9 of Decree No.Decree No. 06/2010/ND-CP dated January 25, 2010 of the Government stipulates that people working in agencies of socio-political organizations and equivalent organizations at the district level (including people working in agencies of the Vietnam Farmers' Union at the district level) are civil servants.

Clause 1, Article 22 of Decree No. 24/2010/ND-CP dated March 15, 2010 of the Government regulating the recruitment, use and management of civil servants stipulates: During the probationary period, the probationary employee shall receive 85% of the salary level 1 of the recruitment category; in case the probationary employee has a master's degree that meets the recruitment requirements, he/she shall receive 85% of the salary level 2 of the recruitment category; in case the probationary employee has a doctoral degree that meets the recruitment requirements, he/she shall receive 85% of the salary level 3 of the recruitment category. Allowances are received according to the provisions of law.

In the case of Ms. Hoang My Linh, she has not clearly stated whether her master's degree is suitable for the recruitment requirements or not? In the case, if when registering for the exam, passing the exam, and being recruited to the Vietnam Farmers' Association at the district level, Ms. Linh had a master's degree in the right major, suitable for the recruitment requirements, then during the probationary period, she will receive 85% of the salary level 2 of the recruitment category (85% of level 2/9 specialist category with coefficient 2.67).

When Ms. Linh completed her probationary period and met the requirements of the recruited civil servant position, the head of the Association sent a document requesting the Provincial Party Committee's Organization Board to issue a decision to appoint and assign her a civil servant salary. Because she has a master's degree that matches her expertise and the requirements of the recruited position, she is entitled to 100% of the salary level 2/9 of the specialist position with a coefficient of 2.67.
