The Prime Minister has just issued a Decision34/2018/QD-TTgprescribes the functions, tasks, powers and organizational structure of the General Department of Market Management under the Ministry of Industry and Trade.
Accordingly, the General Department of Market Management is responsible for submitting to the Minister of Industry and Trade for submission to the Government and the Prime Minister for consideration and decision on draft laws, draft resolutions of the National Assembly, draft ordinances, resolutions of the National Assembly Standing Committee; draft resolutions, decrees of the Government; draft decisions, directives of the Prime Minister on the organization and operation of the Market Management force; on the regime and policies for Market Management civil servants; strategies, national target programs, action programs, long-term development plans, important projects, draft reports on the organization and operation of the Market Management force...
The General Department of Market Management has the function of organizing the implementation of tasks of specialized inspection and examination, handling of administrative violations according to the provisions of law; directing, guiding and implementing specialized inspection and examination activities, combating violations of the law within the scope of functions, tasks and powers of the Market Management force; applying professional measures to serve specialized inspection and examination activities and handling of administrative violations; collecting documents and evidence, taking samples of goods, exhibits, means showing signs of violations, requesting appraisal and testing of samples of goods, documents, papers, and evidence related to violations of the law by organizations and individuals; handling administrative violations.
At the same time, conduct internal inspections, resolve complaints and denunciations; handle according to authority or recommend competent authorities to handle violations of the law related to the Market Management force according to the provisions of law; prevent and combat corruption, negativity and practice thrift and combat waste in the use of assets and funds assigned according to the provisions of law; organize propaganda, dissemination and education of laws on areas under the management of the General Department.
In addition, organize information collection, analysis, assessment, and forecast of the situation to advise and propose to competent authorities to apply preventive measures and combat violations of the law; build, operate and develop information systems, databases on area management, results of specialized inspections, handling of administrative violations, databases on personnel and asset management and other databases serving the activities of the Market Management force as assigned by the Minister and legal regulations; synthesize and report the results of specialized inspections, handling of administrative violations of the Market Management force to competent authorities...
Organizational structure
Regarding organizational structure, the central Market Management organizations include: General Department Office; Department of Organization and Personnel; Department of Synthesis - Planning - Finance; Department of Policy - Legislation; Department of Inspection - Examination; Department of Market Management Operations.
Local Market Management organizations include:
Provincial Market Management Departments under the General Department of Market Management include: Provincial and centrally-run city Market Management Departments; Inter-provincial and centrally-run city Market Management Departments.
District-level Market Management Teams under the Provincial Market Management Department include: District, county, town, city Market Management Teams under provinces, cities under centrally run cities; Inter-district, county, town, city Market Management Teams under provinces, cities under centrally run cities; Specialized Market Management Teams; Mobile Market Management Teams.
The Provincial Market Management Department and the District Market Management Team have legal status, their own seals and are allowed to open accounts at the State Treasury in accordance with the provisions of law.
The General Department of Market Management has a Director General and no more than 4 Deputy Directors General. The Director General and Deputy Directors General are appointed, dismissed and removed from office by the Minister of Industry and Trade in accordance with the provisions of law.
This Decision takes effect from October 12, 2018 and replaces Decision No.19/2009/QD-TTgdated February 6, 2009 of the Prime Minister stipulating the functions, tasks, powers and organizational structure of the Market Management Department under the Ministry of Industry and Trade.
