What does Official Document 486 state?

The article "Urgent Recovery of Land Allocated to Ineligible Individuals in Quy Chau" reflects the following situation: In 2006, the Provincial People's Committee directed the inspection of land and forest allocation in the districts of Ky Son, Tuong Duong, Con Cuong, Que Phong, and Quy Chau. The inspection revealed that in Quy Chau district, 18 households were allocated land in Chau Hanh and Chau Hoi communes but did not meet the eligibility criteria as stipulated in Decree 02 and Decree 163. On March 23, 2007, in Inspection Conclusion No. 87/KL.UBND.KT, the Provincial People's Committee instructed the Quy Chau District People's Committee to recover the 18 land plots allocated to 18 households and individuals that did not meet the eligibility criteria and to transfer them to the forestry land fund for allocation to other households and individuals in need or for lease, ensuring compliance with legal regulations.

However, as of July 2018, five households still refused to return the land, despite the Quy Chau District People's Committee having issued a decision to revoke the land use right certificates and a document to reclaim the land. This situation has prevented many households in Le village, Chau Hoi commune, from accessing the land they were entitled to…

To verify the information reported in the press, on August 27, 2018, in Report No. 486/BC-UBND, the People's Committee of Quy Chau District stated: The information reported by Nghe An Newspaper is accurate. Accordingly, on June 29, 2007, the People's Committee of Quy Chau District issued Decision No. 597/QD-UBND on the revocation and cancellation of land use right certificates for cases where forest land was allocated to ineligible recipients under Decree 163 in Chau Hanh and Chau Hoi communes.

On June 30, 2014, the People's Committee of Quy Chau District issued Notice No. 39/TB-UBND regarding the handover of land areas that had been reclaimed due to incorrect allocation and the harvesting of all reclaimed planted forests in the Khe Ban area. This was to be allocated to the People's Committees of Chau Hanh and Chau Hoi communes for distribution to eligible households and individuals who lacked land for production. Specifically, 13 out of 18 households in Chau Hanh commune who were incorrectly allocated land complied with the land reclamation process and returned the land to the local authorities for allocation to eligible households lacking land for production as per regulations. However, 5 out of 18 households in Chau Hoi commune did not comply and continued planting acacia trees after harvesting (specifically, the households of Mr. and Mrs. Vo Van Hong, Vi Van Thi, Tran Van My, Hoang Nghia Be, and Nguyen Thi Hong).

In response to the above situation, the Quy Chau District People's Committee is directing the Chau Hoi Commune People's Committee to coordinate with the consulting unit to complete the dossiers for the allocation and issuance of land use right certificates to households through a socialized model. In the coming time, the Quy Chau District People's Committee will continue to pay attention to directing the Chau Hoi Commune People's Committee and relevant departments to focus on resolving the above issue completely and promptly hand over the land to the people to stabilize production.

The people have been granted land use right certificates.

In early December 2018, Nghe An Newspaper received information via its hotline: Households in Le village, Chau Hoi commune, had been granted Certificates of Land Use Rights for forestry land!

Upon verification, the information is accurate. This is evidenced by Decision No. 3147/QD-UBND dated November 30, 2018, of the People's Committee of Quy Chau District regarding the allocation of land and issuance of land use right certificates for forestry land to households and individuals in Chau Hoi commune. According to Decision 3147, 22 households residing in Le village, Chau Hoi commune, were allocated land and issued land use right certificates for forestry land, with a total area of ​​514,832 m2. The allocated land plots are located within Chau Hoi commune.

Prior to that, on November 23, 2018, the People's Committee of Quy Chau District issued Notice No. 698/TB-UBND regarding the return of forest land that had been subject to a land reclamation decision in Chau Hoi commune.

Notice 698 states: On June 29, 2007, the People's Committee of Quy Chau District issued Decision No. 597/QD-UBND on the revocation and cancellation of land use right certificates for cases where land was allocated to ineligible individuals under Decree 163 in Chau Hoi commune (995,661 m2 of land was revoked and 8 certificates belonging to 8 households and individuals were canceled). However, to date, these households still possess assets and crops on the aforementioned revoked land.

To ensure that this land area is managed and used in accordance with regulations as soon as possible, and to put an end to the situation where families and individuals are producing crops on the reclaimed land, the People's Committee of Quy Chau District announces the following to the relevant households and individuals and the People's Committee of Chau Hoi Commune: For the relevant households and individuals, they must promptly harvest their crops and dispose of their assets on the land that the People's Committee of Quy Chau District has decided to reclaim. They are prohibited from planting new crops and returning the land to the People's Committee of Chau Hoi Commune for management as per regulations. The People's Committee of Chau Hoi Commune is tasked with delivering Notice No. 698 directly to the relevant households and individuals and organizing meetings with them; focusing on state management of the aforementioned land area, conducting effective public awareness campaigns to ensure the land is managed and used in accordance with regulations; and strictly handling cases of violations of land regulations such as land encroachment and replanting.

According to the Chau Hoi Commune People's Committee, on December 3, 2018, land was allocated and land use right certificates were issued to 22 households in Le village in accordance with Decision No. 3147/QD-UBND of the Quy Chau District People's Committee. At the handover ceremony, the Chau Hoi Commune People's Committee assigned responsibility to the households to manage and use the land and land use right certificates in accordance with the law. They were instructed to prevent encroachment, conversion of land use purposes, or illegal transfers. On December 8, 2018, during a business trip to Chau Hoi commune, in the Khe Ban area, we encountered a group of people planting new acacia trees on one of the forest land areas that the Quy Chau District People's Committee was continuing to reclaim as per Notice No. 698.

It was learned that these are households in Le village who were recently granted land use rights certificates for forestry land by the Chau Hoi Commune People's Committee. These households reported that, to date, 1/5 of the households who were allocated land under Decree 163 were ineligible and have harvested their crops and returned the land. After this household finished harvesting, the people of Le village received the land back and began planting new acacia trees…
