New regulations on granting citizen identification cards of the Ministry of Public Security
(Baonghean.vn) - The Ministry of Public Security has just issued Circular 59/2021 detailing the revocation of identity cards (ID cards) when completing procedures to switch to chip-embedded citizen identification cards (CCCDs).
Do not require people to provide ID card confirmation
The Ministry of Public Security has just issued Circular 59/2021 detailing the implementation of the Law on Citizen Identification (CCCD) and Decree No. 137/2015 (amended by Decree 37/2021). The Circular takes effect from July 1.
According to Circular 59, cases that have been issued a CCCD or birth certificate with a personal identification number can use information about the CCCD number and personal identification number to transact with agencies, organizations and individuals.

In particular, the QR Code on the CCCD card with electronic chip stores information about the CCCD number and ID card number of the citizen.
"Agencies, organizations, and individuals can check information about citizens' ID card numbers and CCCD numbers by scanning QR codes, without requiring citizens to provide ID card or CCCD number confirmation papers," the Ministry of Public Security noted.
The Ministry of Public Security is aware of the recent issue that many people are worried that when making a chip-embedded ID card, the identification number will be different from the previous ID number, so they must have an additional paper confirming these two numbers, otherwise they will have trouble in future transactions.
Therefore, with the new regulations of the Ministry of Public Security, the new CCCD card will integrate the old ID number, which will help people make transactions more convenient, avoiding the need to request additional documents.
Particularly for cases where the QR code on the CCCD card does not contain information about the old ID card number or CCCD, the Ministry of Public Security requires the police agency that receives the request for CCCD issuance to be responsible for issuing a certificate of the old ID card number or CCCD to the citizen upon request.
In case the information of the citizen's old ID card or CCCD number is not in the national population database, the police will ask the citizen to provide the original or a copy of the CCCD or ID card (if available).
Latest regulations of the Ministry of Public Security on procedures for issuing, exchanging and reissuing chip-embedded CCCD cards
In particular, also in Circular 59, the Ministry of Public Security also stipulates that citizens can register for a certificate of ID card number, CCCD on the National Public Service Portal, the Ministry of Public Security's Public Service Portal at any police agency that receives applications for CCCD cards.
Specifically, Article 10 of the Circular clearly states that citizens can directly go to the competent police agency to request the issuance, exchange, or re-issuance of a CCCD card at the place where they permanently or temporarily reside to request the issuance, exchange, or re-issuance of a CCCD card.
The settlement results will be updated and announced on the National Public Service Portal and the Ministry of Public Security Public Service Portal.
According to information from the Ministry of Public Security, in case citizens request to issue, change, or reissue a CCCD card on the National Public Service Portal or the Ministry of Public Security Public Service Portal, citizens can choose the service and check their information in the National Population Database.
“If the information is correct, register the time and location of the request for a CCCD card. The system will automatically forward the citizen's request to the police agency where the citizen made the request,” the Ministry of Public Security stated.
According to Circular 59, there are two new points noted by the Ministry of Public Security, which are:the firstPeople can go to any competent police agency (including temporary residence) to apply for a CCCD, without having to return to their permanent residence as before.

MondayIn addition to going directly to the police headquarters, people can apply for a CCCD online.
Regarding the procedure for issuing, exchanging, and reissuing CCCD cards, the Ministry of Public Security stipulates 6 basic steps.The firstCitizens go to the competent police agency to receive requests for issuance, exchange, or re-issuance of CCCD cards at the place of permanent or temporary residence to request issuance of CCCD cards.
Next, police officers collect citizen information: Search for citizen information in the national population database, select the type of issue and describe identification characteristics, collect fingerprints, take portrait photos, print CCCD information collection form, population information collection form (if any), population information update and correction form (if any) for citizens to check, sign and clearly state their full name, collect fees according to regulations, issue appointment papers to return settlement results.
TuesdayThe police will collect the ID card and CCCD in use in case citizens complete procedures to convert from ID card to CCCD card or change CCCD card.Wednesday- Look up CCCD archive to verify citizen information (if any).Thursday, process, approve applications for issuance, exchange, and re-issuance of CCCD cards.Friday, return CCCD card and results of issuance, exchange, re-issuance of CCCD card.
"In case citizens register to return their CCCD cards to the requested address, the police agency will make a list, coordinate with the delivery service unit to carry out the delivery and citizens must pay the fee according to regulations," the Ministry of Public Security stated.
Old ID cards will be revoked when switching to citizen ID cards from July 1
Also according to the provisions of Circular 59/2021, the competent authority will collect the ID card in use in case the citizen completes the procedure to switch from the ID card to the CCCD card (Clause 3, Article 11).
“Recall the ID card and CCCD card in use in case citizens complete procedures to switch from ID card to CCCD card, or change CCCD card”, Clause 3, Article 11 of Circular 59 stipulates.
Accordingly, from July 1, 2021, all old ID cards and barcoded CCCDs will be collected when people complete procedures to switch to chip-embedded CCCD cards, instead of having the corners cut off and returned to people as before.

According to current regulations, when doing procedures to convert from ID card to CCCD, only in cases where the ID card is damaged, peeled, or unclear (photo, ID number and letters) will it be revoked:
When a citizen completes the procedure to switch from a 9-digit or 12-digit ID card to a CCCD card, the officer receiving the application will proceed as follows: For a 9-digit ID card, in case the 9-digit ID card is still clear (photo, ID number and letters), a CCCD return appointment paper will be issued along with the uncut corner of the ID card for the citizen to use while waiting for the CCCD card to be issued.
When returning the CCCD card, the officer receiving the application will ask the citizen to submit the CCCD card return appointment paper along with the ID card and cut off the upper right corner of the front of the ID card, each side of the right corner is 2cm, record it in the application and return the cut-off corner of the ID card to the person receiving the CCCD card. In case the citizen requests to return the CCCD card by delivery to the requested address, the CCCD management agency where the application is received will cut the corner and return the cut-off corner of the ID card immediately after receiving the citizen's application.
In case the 9-digit ID card is damaged, peeled off, or unclear (photo, ID number and letters), the ID card will be collected and destroyed, recorded in the file and a Certificate of ID Number will be issued.
For 12-digit ID cards: In case the 12-digit ID card is still clear (photo, ID number and letters), issue an appointment paper to return the CCCD card along with the uncut corner of the ID card for the citizen to come to complete the procedure to use while waiting for the CCCD card to be issued.
When returning the CCCD card, the officer receiving the application will ask the citizen to submit the CCCD card return appointment paper along with the ID card and cut off the upper right corner of the front of the ID card, each side of the right corner is 1.5cm, record it in the application, and return the cut-off corner of the ID card to the citizen. In case the 12-digit ID card is damaged, peeled off, or unclear (photo, ID number and letters), the ID card will be collected and destroyed, recorded in the file and a Certificate of ID Number will be issued.
