New guidance on the Residence Law takes effect from July 1
The Government has just issued Decree 62/2021/ND-CP (dated June 29) detailing a number of articles of the Law on Residence (hereinafter referred to as Decree 62/2021), effective from July 1.

People without temporary residence must immediately declare information about residence.
According to Decree 62/2021/ND-CP detailing a number of articles of the Law on Residence, effective from July 1, people without a temporary residence must immediately declare information about their residence. This Decree details a number of articles of the Law on Residence with six contents.
Of particular interest are the residence of people without permanent or temporary residence; types of papers and documents proving legal residence, papers and documents proving personal relationships; records and procedures for deleting permanent and temporary residence registration and the Residence Database.
Specifically, people without a permanent or temporary residence must immediately declare their residence information to the residence registration agency at their current place of residence.
In case, through inspection and review, the residence registration agency discovers that a person is required to declare information about residence, it is responsible for guiding and requesting that citizen to make the declaration.
In addition, when registering for residence, citizens need to prove their legal residence with one of the following papers and documents: Papers and documents certifying land use rights, house ownership rights or assets attached to land issued by competent authorities; Construction permit; Contract for sale of state-owned housing or documents on liquidation price of state-owned housing; Papers on purchase, hire-purchase, receipt of gifts, inheritance, etc.
Information can be searched in the residency database.
Also according to Decree 62/2021, citizens are provided and exchanged their information in the Residence Database.
Citizen information is collected and updated in the Residence Database from the following sources: National Population Database; Citizen Identification Database; Electronic Civil Status Database; National Database and other specialized databases shared with the Residence Database; Papers, documents, books on registration, residence management, household registration records, registration records, residence management, citizen identification records, civil status papers.
The document also stipulates information in the Citizens' Residence Database, including 32 contents. There are many specific contents such as: Residence record number; Permanent residence, time of starting permanent residence; reason and time of permanent residence cancellation; Personal identification number; Surname, middle name and given name; Date of birth; Gender; Place of birth registration; Hometown; Ethnicity; Religion; Nationality; Marital status; Occupation (except for the People's Armed Forces); Blood type...
Decree 62/2021/ND-CP takes effect from July 1, 2021 and replaces Decree 31/2014/ND-CP dated April 18, 2014.
