New guidelines on the Law on Residence will take effect from July 1st.

The government has just issued Decree 62/2021/ND-CP (dated June 29) detailing some provisions of the Law on Residence (hereinafter referred to as Decree 62/2021), which takes effect from July 1.

Individuals without a temporary residence must immediately declare their residence information.

According to Decree 62/2021/ND-CP, which details some provisions of the Law on Residence and takes effect from July 1st, individuals without a temporary residence must immediately declare their residence information. This decree details six provisions of the Law on Residence.

Of particular interest are the residence of those without a permanent or temporary residence; documents proving legal residence and personal relationships; procedures for canceling permanent and temporary residence registration; and the Residence Database.

Specifically, individuals without a permanent or temporary residence must immediately declare their residence information to the residence registration authority at their current place of residence.

If, upon inspection and review, the residence registration authority discovers that a person is required to declare their residence information, it is responsible for guiding and requiring that citizen to make the declaration.

In addition, citizens registering for residence must prove their legal residence with one of the following documents: Documents certifying land use rights, house ownership rights, or ownership of assets attached to the land issued by competent authorities; Construction permits; Contracts for the purchase and sale of state-owned housing or documents on the valuation and liquidation of state-owned housing; Documents on purchase, lease-purchase, gift, inheritance, etc.

The information can be found in the residence database.

According to Decree 62/2021, citizens are also provided with and can exchange their information in the Residence Database.

Information about citizens is collected and updated in the Residence Database from the following sources: National Population Database; Citizen Identity Card Database; Electronic Civil Registry Database; National and other specialized databases shared with the Residence Database; Documents, records, and books on residence registration and management, household registration archives, residence registration and management records, citizen identity card archives, and civil registry documents.

The document also specifies the information in the Citizen's Residence Database, comprising 32 items. These include many specific details such as: Residence record number; Permanent residence, start date of permanent residence; reason and time of deregistration; Personal identification number; Surname, middle name, and given name; Date of birth; Gender; Place of birth registration; Hometown; Ethnicity; Religion; Nationality; Marital status; Occupation (excluding members of the People's Armed Forces); Blood type, etc.

Decree 62/2021/ND-CP takes effect from July 1, 2021 and replaces Decree 31/2014/ND-CP dated April 18, 2014.
