Family broken up, in trouble with the law because of jealousy

Angry because Ms. N. brought her sister to matchmake for her husband, Hong brought 10 liters of paint and poured it straight on her head.

On February 25, the People's Court of Ho Chi Minh City opened an appeal trial for defendant Phan Thi Duyen Hong (46 years old, residing in District 12, Ho Chi Minh City) on the charge of "Intentionally causing injury".

Previously, Hong was sentenced to 6 months in prison by the People’s Court of Thu Duc City. After the first instance trial, the defendant filed an appeal requesting a suspended sentence. The victim also filed an appeal requesting an increased sentence for the defendant.

According to the first instance verdict, at around 8:00 a.m. on August 17, 2019, Hong and her friend went to a coffee shop in Binh Tho ward, Thu Duc district to drink water and met her husband, Mr. Duong Thanh H., along with Ms. Lam Thi Thu N. and 2 other people sitting there drinking coffee.

Seeing that, Hong got angry.jealous, ran to buy 10 liters of paint and called 2 people who were working for me to come and help.

At 10:15 a.m. the same day, when she saw Ms. N. being taken home by her friend, Hong quickly followed. When she reached neighborhood 3, Binh Tho ward, she rushed forward and grabbed Ms. N.'s shirt, causing her to fall. Then, Hong rushed forward and beat and cursed her. Not yet satisfied, she poured 10 liters of paint on Ms. N.'s head before leaving.

After being assaulted, Ms. N. went to the police station to report the incident. The injury assessment results showed that Ms. N. suffered 8% injury.

At the trial on February 25, Hong admitted to committing the crime as charged in the indictment. Justifying his crime, Hong said that he was angry that Ms. N. knew that the defendant's husband had a wife and children but still brought her sister to help matchmake, causing Hong's family to fall apart. The defendant said that after the incident, the couple were now divorced.

Hong asked the panel of judges to consider giving the defendant a suspended sentence so that he could return home to take care of his three young children because after the divorce, he had to raise the children alone.

Considering that the defendant’s actions have violated the health of citizens protected by law, causing negative impacts on social order. However, the defendant has repented, committed the crime for the first time and has compensated for the consequences. In addition, the defendant is in difficult circumstances, raising 3 small children alone.

Therefore, after consideration, the panel of judges partially accepted the defendant's appeal, changing the sentence from 6 months in prison to 6 months in prison with a suspended sentence.
