Prosecution of a series of district officials for land violations

According to information from the Investigation Police Agency of Cao Bang Province, this unit is investigating the case of Lack of responsibility causing serious consequences and Abusing position and power while performing official duties that occurred in Thach An district, Cao Bang province in the period 2018 - 2021.

The police force served the decisions on two subjects Nghiem Xuan Thong and Le Van Dieu.

The Provincial Police Department's Investigation Police Agency has just issued Decisions to prosecute the case, Decisions to prosecute the accused and applied preventive measures against 10 subjects, including temporarily detaining 2 subjects including: Le Van Dieu (civil servant of the Tax Department of Thach An district) for the act of Lack of responsibility causing serious consequences; Nghiem Xuan Thong (Chairman of the People's Committee of Dong Khe town) for the act of Abusing position and power while performing official duties.

At the same time, 7 subjects were banned from leaving their place of residence: Nong Cao The (Party Secretary of Dong Khe town, former Chairman of Dong Khe town People's Committee) for the act of Abusing position and power while performing official duties; Dinh Trong Nghia (civil servant of the Department of Natural Resources and Environment of Thach An district); Nong Duc Tuan (Vice Chairman of Dong Khe town People's Committee, former cadastral civil servant of Trong Con commune, Thach An district); Dang Thu Phuong (Deputy Head of the Department of Natural Resources and Environment of Thach An district); Dinh Thi Hanh (civil servant of the Tax Department of Thach An district); Hoang Van Khoa (Deputy Head of the Tax Department of Hoa An district, former Deputy Head of the Tax Department of Thach An district); Be Nhat Hoang (Chief of the Tax Department of Thach An district), along with the act of Lack of responsibility causing serious consequences.

In addition, defendant Hoang Thi Ngan (a land officer of Dong Khe town, Thach An district) was also investigated for the act of Abusing position and power while performing official duties. Previously, the defendant was arrested by the Investigation Police Agency of Cao Bang province for the act of accepting bribes.

Accordingly, during their time working at the People's Committee of Dong Khe town, when citizens asked Nong Cao The, Nghiem Xuan Thong and Hoang Thi Ngan to help resolve the application for exemption from land use conversion fees, although they clearly knew that it was not the right subject, they still created conditions to resolve it "for personal motives, to favor and create conditions for relatives and acquaintances".

For the subjects working at the Tax Department and the Department of Natural Resources and Environment of Thach An district, in the process of implementing the procedures for permitting the change of land use purpose, there were violations in determining the land area within and outside the limit for subjects exempted or reduced from land use fees, leading to the determination of financial obligations not in accordance with the provisions of law, causing loss of revenue to the State Budget.
