Nghe An attaches responsibility to leaders in preventing and combating smuggled and counterfeit goods
Although the authorities have actively intervened to deal with the problem, the problem of smuggled and counterfeit goods in Nghe An is still complicated, causing damage to legitimate businesses as well as the interests of consumers. This is a reality that requires the relevant authorities and local authorities to continue to synchronously deploy solutions, especially from now until the end of the year.
Handling multiple violations
On September 11, the Department of Investigation Police on Corruption, Economic, Smuggling, and Environmental Crimes, Nghe An Provincial Police presided over and coordinated with the Market Management Department to inspect the business establishment of PTN household (born in 1985), in Hung Tay commune, Hung Nguyen district, discovered and seized 1,776 moon cake products of various types produced abroad, of unknown origin.

Previously, on September 9, the Department of Investigation Police on Corruption, Economic Crimes, Smuggling, and Environmental Crimes, Nghe An Provincial Police coordinated with the Market Management Department to inspect a children's toy store on Dinh Cong Trang Street (Le Mao Ward, Vinh City). During the inspection, nearly 18,000 Mid-Autumn Festival toys for children were discovered and seized without invoices or documents proving their origin. Currently, the authorities have destroyed all of the above goods.

Most recently, on September 20, the Standing Vice Chairman of the Provincial People's Committee, Le Hong Vinh, signed a decision to impose an administrative penalty on the HO hair accessories business household, located at 57 Le Loi Street, Vinh City. The legal representative of the business household is Ms. BTNQ (born in 1994).
The penalty decision clearly stated that the HO hair accessories business household had traded goods of unknown origin and source, the violating goods were cosmetics worth VND 100 million or more (trading 8,212 bottles of Royal brand shampoo (600ml herbal shampoo) and 1,503 bottles of Royal brand conditioner (600ml herbal shampoo) without invoices or documents proving legal origin and source, valued at VND 340,025,000).
Accordingly, the HO hair accessories business was fined 90 million VND. The remedial measure is to force the destruction of administrative violation evidence, which is goods of unknown origin.
According to the report of the Provincial Steering Committee 389, from December 16, 2023 to August 15, 2024, the authorities detected and handled 5,265 violations, prosecuted 1,044 cases/1,369 subjects, and collected a total of 180 billion VND for the budget.
Continue to implement synchronous solutions
Based on the direction of the Government, the Prime Minister, the National Steering Committee 389, and the Provincial People's Committee, recently, the Provincial Steering Committee 389 has issued many documents directing the promotion of the fight againstsmuggle, commercial fraud and counterfeit goods, handling unusual developments in the market.
Functional forces and local authorities have seriously and promptly implemented, simultaneously launching many synchronous solutions from staff work to direct combat against smuggling, banned goods, counterfeit goods, and trade fraud.

However, in reality, the tricks of the subjects are increasingly sophisticated, so the fight against smuggling, trade fraud, counterfeit goods, and banned goods encounters many difficulties: The subjects often legalize smuggled goods with false sales invoices; use fake invoices, rotate invoices for many shipments; transport goods in small quantities, disguise, and hide them with other goods in homemade truck beds and compartments to avoid inspection and control by authorities.
In addition, these subjects often take advantage of people's lack of knowledge and low income to bring fake and poor quality goods to rural, mountainous, remote areas for consumption on mobile sales vehicles.
Taking advantage of the development of information technology and e-commerce to trade in infringing goods and commit commercial fraud through e-commerce platforms, social network accounts on Facebook, Zalo, etc. causes many difficulties for authorities in tracing, accurately determining actual addresses, and conducting inspections and controls according to regulations.
While the propaganda and mobilization of people to participate in the fight against smuggling and trade fraud are still formal and not widely spread in the community. A part of consumers have a mentality of wanting cheap goods and cannot distinguish between genuine and fake goods, so they are easily exploited by criminals. This is also an issue that greatly affects the prevention and fight against counterfeit and poor quality goods in the market.

Mr. Nguyen Hong Phong - Deputy Director of Nghe An Market Management Department said: In the coming time, it is necessary to continue to effectively implement the coordination regulations between functional forces (Police, Border Guard, Customs, Market Management, Forestry, Industry and Trade, Health) ... with local authorities to improve the effectiveness of the fight against smuggling and counterfeit goods through strengthening local management; grasp market developments, clarify methods and tricks of all types of subjects trading in smuggled, banned and counterfeit goods in each locality. In addition, identify key subjects to develop a plan to fight, proactively arrange forces, apply professional measures to inspect, supervise and handle.
For e-commerce business activities, especially sales activities via social networks such as Facebook, Zalo... it is necessary to deploy synchronous solutions on professional operations to accurately identify the addresses of subjects taking advantage of e-commerce to trade in counterfeit and poor quality goods in the area for timely handling.
In addition, propaganda and mobilization work to encourage people to join authorities in the fight against using fake and poor quality goods will also be promoted, along with organizing the signing of commitments with individual business households, business establishments and enterprises not to produce, trade or assist in smuggling, counterfeit and banned goods in the area.
Steering Committee 389 will also direct functional sectors to closely coordinate with businesses and industry associations in the fight against counterfeit goods, fake goods, and goods that infringe intellectual property rights. At the same time, it will advise and guide consumers to choose stores with clear addresses, and use software to check the origin of barcodes to determine whether the goods are genuine or not. In case of detecting stores selling goods of unknown origin, fake goods, or poor quality goods, it is necessary to immediately report to the authorities for prevention and handling.
