The following traffic violations by local police officers will be directly penalized starting in 2025.
According to new regulations from the Ministry of Public Security effective from 2025, when not accompanied by traffic police, commune police officers are only allowed to directly issue fines for certain traffic violations.
Article 30 of Circular No. 73/2024/TT-BCA of the Ministry of Public Security, effective from January 1, 2025, stipulates the duties of traffic police and the duties of other forces within the People's Public Security.
Accordingly, the duties of other forces within the People's Police are stipulated as follows:
Deploy personnel, equip them with vehicles, technical equipment, weapons, and support tools to participate in patrolling and controlling road traffic order and safety according to plan.
Handling violations within their jurisdiction; compiling statistics and reporting on violations of the law and road traffic accidents; and reporting on the results of patrols, inspections, and handling of violations as assigned in the plan.
In the absence of traffic police officers, the commune police will conduct patrols and inspections according to the plan issued by the competent authority and report the situation, results of patrol and inspection activities, and handling of violations to the traffic police force.
Commune police are only authorized to patrol, monitor, and handle violations on commune and village roads within their jurisdiction.
When commune police discover motorcyclists or drivers of rudimentary vehicles committing violations such as: not wearing helmets as required; carrying more passengers than permitted; carrying bulky goods exceeding the permitted dimensions; stopping or parking illegally; swerving, weaving, or driving on one wheel for two-wheeled vehicles; not having a left rearview mirror as required; using an umbrella; towing or pushing other vehicles or objects; driving underage; or when they discover vehicles seriously violating road traffic safety, security, or social order that, if not stopped promptly, would cause dangerous consequences for society, they may handle the matter according to the law.
During the process of resolving and handling the aforementioned violations, if other violations are discovered, they will be handled according to the competent authority's jurisdiction. If the violations exceed the authority to impose penalties, an administrative violation report will be drawn up and submitted to the competent authority for a decision on administrative penalties.
The circular also stipulates the duties of traffic police as follows:
Develop a plan for patrolling and monitoring road traffic order and safety.
In cases where the Minister of Public Security decides on the mobilization, the Traffic Police Department is responsible for developing the plan.
In cases where the provincial police chief decides on the mobilization, the Traffic Police Department is responsible for developing the plan.
In cases where the district police chief decides on the mobilization, the traffic and public order police team under the district police is responsible for developing the plan.
Within two working days of receiving the mobilization decision, the traffic police units specified in point a of this Clause must develop a plan and submit it to the competent authority that issued the mobilization decision for issuance and implementation.
Directing, managing, inspecting, supervising, guiding, and organizing the implementation of patrols and controls to maintain order and safety in road traffic.
Imposing administrative penalties within their jurisdiction.
