Motorbike violations that commune police can directly fine from 2025

According to new regulations of the Ministry of Public Security from 2025, when not accompanied by traffic police, commune police are only allowed to directly fine certain violations.

Article 30 of Circular No. 73/2024/TT-BCA of the Ministry of Public Security, effective from January 1, 2025, stipulates the duties of traffic police and the duties of other forces in the people's public security.

Accordingly, the tasks of other forces in the people's police are prescribed as follows:

Arrange forces, equip vehicles, technical equipment, weapons, and support tools to participate in patrolling and controlling road traffic order and safety according to plan.

Handle violations according to authority; compile statistics and report cases of law violations and road traffic accidents; results of patrols, controls and handling of violations according to the assignment in the plan.

In case there is no traffic police force accompanying, the commune police shall conduct patrols and controls according to the plan issued by the competent authority and report the situation, results of patrols, controls and handling of violations to the traffic police force.

Commune police are only allowed to patrol, control, and handle violations on commune and village roads under their management.

When the commune police detect drivers of motorbikes and rudimentary vehicles committing violations of the law such as: Not wearing helmets as prescribed; carrying more people than prescribed; carrying bulky goods or goods exceeding the prescribed size limit; stopping or parking the vehicle in violation of regulations; weaving, swerving, driving on one wheel for two-wheeled vehicles; not having a rearview mirror on the left as prescribed; using an umbrella; pulling or pushing other vehicles or objects; not being of legal age to operate a vehicle as prescribed or detecting vehicles that seriously violate road traffic order and safety, security and social order, if not stopped promptly, will cause dangerous consequences for society, they will be handled according to the provisions of the law.

In the process of resolving and handling the above violations, if other violations are discovered, they will be handled according to authority. If the sanctioning authority is exceeded, a record of administrative violations will be drawn up and reported to the competent authority to issue a decision on administrative sanctioning.

The Circular also stipulates the duties of the Traffic Police as follows:

Develop a plan to patrol and control road traffic order and safety.

In case the Minister of Public Security decides on mobilization, the Traffic Police Department is responsible for developing a plan.

In case the provincial police director decides to mobilize, the Traffic Police Department is responsible for developing a plan.

In case the district police chief decides on mobilization, the traffic and order police team under the district police is responsible for developing a plan.

Time for developing the plan and the content of the plan within 2 working days from the date of receiving the mobilization decision, the traffic police units specified in Point a of this Clause must develop the plan and submit it to the competent authority that issued the mobilization decision for promulgation and implementation.

Direct, operate, inspect, urge, guide and organize the implementation of patrolling, controlling order and road traffic safety.
