Penalties for not having mandatory motorcycle insurance

Ms. Nguyen Thi Tham, residing in Nghi Xuan commune, Vinh city, asked: How much will a motorcyclist be fined if he/she does not carry a compulsory motorbike insurance certificate?

Reply:

Clause 2, Article 18 of Decree 168/2024/ND-CP clearly states that a fine of VND 200,000 - 300,000 shall be imposed for one of the following violations of compulsory civil liability insurance certificates of motor vehicle owners for motorbikes:

Drivers of motorbikes, mopeds, vehicles similar to motorbikes and vehicles similar to motorbikes engaged in transport business do not carry a valid certificate of compulsory civil liability insurance for motor vehicle owners;

Drivers of motorcycles, mopeds, vehicles similar to motorcycles and vehicles similar to mopeds do not have a valid certificate of compulsory civil liability insurance for motor vehicle owners;

Thus, motorcyclists who do not carry a valid certificate of compulsory civil liability insurance for motor vehicle owners or do not have a valid certificate of compulsory civil liability insurance for motor vehicle owners will be fined from VND 200,000 to VND 300,000.

Previously, according to the provisions of Clause 2, Article 21 of Decree 100/2019/ND-CP amended by Clause 11, Article 2 of Decree 123/2021/ND-CP, drivers of motorbikes, motorbikes, and similar vehicles who do not have or do not carry a valid Certificate of Civil Liability Insurance of the Motor Vehicle Owner shall be fined from VND 100,000 to VND 200,000.
