Amnesty work must ensure fairness, objectivity, transparency, and targeting of the right subjects.

That is the request of Nghe An Provincial People's Committee in Plan No. 178/KH-UBND on implementing amnesty work in 2025.

Accordingly, the Provincial People's Committee requests relevant sectors to thoroughly grasp and seriously implement Decision No. 266/2025/QD-CTN dated March 3, 2025 of the President and Instruction No. 21/HD-HDTVDX dated March 7, 2025 of the Amnesty Advisory Council.

Thereby, propagating the State's special leniency policy and the nation's humanitarian tradition towards convicted criminals; at the same time, encouraging those serving prison sentences to repent, reform, work, study, and reform to enjoy leniency and become useful people to society.

Amnesty work must be carried out promptly, in accordance with the law, ensuring democracy, fairness, objectivity, publicity, transparency, strict adherence to the right subjects, conditions, and regulations, and preventing negative errors from occurring.

Amnesty must ensure requirements on domestic and foreign affairs, national security, and social order and safety, contributing to the effective implementation of the "National Strategy on Crime Prevention and Control for the 2016-2025 period and orientation to 2030", creating favorable conditions for amnestied people to quickly reintegrate into the community, stabilize their lives, and prevent recidivism.

Plan No. 178/KH-UBND March 18, 2025 of the Provincial People's Committee also assigns specific responsibilities to relevant sectors. In which:

Provincial Police:

- Advise and direct the effective implementation of Decision No. 266/2025/QD-CTN dated March 3, 2025 of the President; Instruction No. 21/HD-HDTVĐX dated March 7, 2025 of the Amnesty Advisory Council and Decrees and Decisions of the Prime Minister detailing the implementation of the Law on Enforcement of Criminal Judgments on community reintegration; credit for people who have completed their prison sentences...

- Review, consider, propose and establish records and lists of prisoners who meet the conditions and standards for amnesty in accordance with the President's Decision, the Guidance of the Amnesty Advisory Council and the Plan of the Ministry of Public Security.

- Proactively grasp the number, characteristics, and situation of amnestied people in the locality to have an effective plan for reception, management, education, and assistance; not to affect security and order; promptly detect and strictly handle those who re-offend and violate the law.

- Organize the reception and handling of complaints and denunciations related to amnesty work in accordance with regulations.

- Coordinate with relevant agencies, news agencies and the press to widely disseminate information about the amnesty work in 2025; mobilize officials and people to help and support people who have completed their prison sentences, including those who have been granted amnesty, to reintegrate into the community, reform, and soon stabilize their lives.

- Organize the ceremony to announce the President's decision on amnesty and release the amnestied person.

- Direct the Provincial Police Detention Center to ensure the safety of detention facilities to organize the implementation of the 2025 amnesty work with good results.

- Coordinate with relevant departments and branches to estimate funding to support amnesty work and community reintegration activities for amnestied people returning to their locality of residence.

Provincial People's Court:

- Review, prepare records, organize consideration, and propose amnesty for those who are temporarily suspended from serving prison sentences and are eligible for amnesty according to Decision No. 266/2025/QD-CTN dated March 3, 2025 of the President, Instruction No. 21/HD-HDTVĐX dated March 7, 2025 of the Amnesty Advisory Council and direction of the Supreme People's Court to send to the Interdisciplinary Appraisal Team.

- Notify the Provincial Police Criminal Enforcement Agency and the Provincial Police Detention Center of prisoners who are appealing under the supervisory review or retrial procedures in the direction of aggravating criminal liability.

Provincial People's Procuracy:

- Supervise the preparation of amnesty proposal files and the implementation of amnesty decisions according to regulations in Clause 2, Article 30 of the Amnesty Law.

- Coordinate with the Provincial People's Court to detect prisoners who have appealed under the supervisory review or retrial procedures in the direction of increasing criminal liability to promptly notify the Provincial Police Criminal Enforcement Agency and the Provincial Police Detention Center.

- Exercise the right to request and make recommendations when inspecting the preparation of amnesty proposals and the implementation of amnesty decisions; inspecting the settlement of complaints according to the provisions of Article 37 of the Amnesty Law.

Provincial Civil Judgment Enforcement Department:

Direct, guide and urge the Civil Judgment Enforcement Offices to implement the provisions of Clause 1, Article 31 of the Amnesty Law; coordinate with relevant units to implement the provisions of the Amnesty Law and the President's Decision on amnesty in 2025.

Social Policy Bank, Nghe An Province Branch:

Continue to effectively implement Plan No. 860/KH-UBND dated November 14, 2023 of the Provincial People's Committee to implement Decision No. 22/2023/QD-TTg dated August 17, 2023 of the Prime Minister on credit for people who have completed their prison sentences; advise on the use of local budget capital entrusted through the Social Policy Bank to provide loans to people who have completed their prison sentences according to the provisions of Decision No. 22/2023/QD-TTg.

Department of Home Affairs:

- Preside over and coordinate with relevant agencies and social organizations to effectively implement Decree No. 49/2020/ND-CP dated April 17, 2020 of the Government detailing the implementation of the Law on Enforcement of Criminal Judgments on community reintegration; pay attention to receiving and helping pardoned people with especially difficult circumstances to borrow capital, create jobs, stabilize their lives, integrate into the community, prevent recidivism and violations of the law.

- Coordinate to provide full certificates, confirmations and necessary information and documents related to the person being considered for special pardon.

Health service:

Direct hospitals and medical centers to organize examinations and provide documents on prisoners' illnesses related to the request for amnesty in accordance with regulations.

People's Committees of districts and cities,town.

- Direct the provision of information and documents related to personal identity; issue certificates, confirmation of family circumstances or other necessary papers and documents of the person proposed for amnesty.

- Direct the assignment of specific tasks to the People's Committees of communes, wards and towns; branches, agencies and social organizations in the locality to effectively implement Decree No. 49/2020/ND-CP of the Government dated April 17, 2020 detailing the implementation of the Law on Execution of Criminal Judgments on community reintegration, Decision No. 22/2023/QD-TTg dated August 17, 2023 of the Prime Minister on credit for people who have completed their prison sentences.

The Provincial People's Committee also proposed:The Provincial Fatherland Front coordinates with relevant agencies (Department of Culture, Sports and Tourism, Nghe An Newspaper, Nghe An Radio and Television Station...):Disseminate and popularize the policy on amnesty in 2025; direct and coordinate with localities to continue educating and helping amnestied people reintegrate into the community, create jobs, stabilize their lives and become useful people to society, and prevent recidivism. Monitor the activities of competent agencies, organizations and individuals in implementing amnesty in 2025 in accordance with the law.

-Relevant departments and branches shall, based on their functions and tasks, coordinate to effectively implement amnesty work and ensure that amnestied persons reintegrate into the community.

According to the plan of the Provincial People's Committee on May 1, 2025, the organization will release people who have been pardoned according to the President's Decision.
