The amnesty process must ensure fairness, objectivity, transparency, and target the right individuals.
This is a requirement of the Nghe An Provincial People's Committee in Plan No. 178/KH-UBND on the implementation of the amnesty program in 2025.
Accordingly, the Provincial People's Committee requests relevant departments to thoroughly understand and seriously implement Decision No. 266/2025/QD-CTN dated March 3, 2025, of the President and Guidance No. 21/HD-HDTVDX dated March 7, 2025, of the Clemency Advisory Council.
Through this, we will publicize the State's special policy of leniency and the nation's humanitarian tradition towards convicted criminals sentenced to imprisonment; at the same time, we will encourage those serving prison sentences to repent, actively work, study, and reform themselves in order to receive leniency and become useful members of society.

The amnesty process must be conducted promptly, in accordance with the law, ensuring democracy, fairness, objectivity, openness, transparency, and strict adherence to the criteria and regulations, preventing any errors or negative consequences.
Amnesty must ensure compliance with domestic and foreign policy requirements, national security, and social order and safety, contributing to the effective implementation of the "National Strategy for Crime Prevention and Control for the period 2016-2025 and orientation to 2030," creating favorable conditions for those granted amnesty to quickly reintegrate into the community, stabilize their lives, and prevent recidivism.
Plan No. 178/KH-UBND dated March 18, 2025, of the Provincial People's Committee also assigns specific responsibilities to relevant departments. These include:
Provincial Police:
- To advise and direct the effective implementation of Decision No. 266/2025/QD-CTN dated March 3, 2025, of the President; Guidance No. 21/HD-HDTVDX dated March 7, 2025, of the Clemency Advisory Council; and the Decrees and Decisions of the Prime Minister detailing the implementation of the Law on Execution of Criminal Sentences regarding community reintegration; credit for those who have completed their prison sentences, etc.
- Review, consider, propose, and compile dossiers and lists of prisoners who meet the eligibility criteria for amnesty in accordance with the President's Decision, the Guidelines of the Amnesty Advisory Council, and the Ministry of Public Security's Plan.
- Proactively ascertain the number, characteristics, and circumstances of those granted amnesty and returning to their localities in order to plan for effective reception, management, education, and assistance; prevent any impact on security and order; and promptly detect and strictly punish those who re-offend or violate the law.
- The organization shall receive and process complaints and denunciations related to the amnesty process in accordance with regulations.
- Coordinate with relevant agencies and media outlets to widely publicize the 2025 amnesty program; mobilize officials and the public to help and support those who have completed their prison sentences, including those granted amnesty, to reintegrate into the community, reform, and stabilize their lives as soon as possible.
- Organize a ceremony to announce the President's decision on amnesty and release those granted amnesty.
- Direct the Provincial Police Detention Center to ensure the safety of the detention facility in order to successfully implement the 2025 amnesty program.
- Coordinate with relevant departments and agencies to estimate the funding needed to support the amnesty process and community reintegration activities for those granted amnesty and returning to their places of residence.

Provincial People's Court:
- Review, prepare dossiers, organize the examination and propose amnesty for those whose sentences are temporarily suspended and who meet the eligibility criteria for amnesty as stipulated in Decision No. 266/2025/QD-CTN dated March 3, 2025, of the President, Guidance No. 21/HD-HDTVDX dated March 7, 2025, of the Amnesty Advisory Council, and the directives of the Supreme People's Court, to be submitted to the Inter-agency Appraisal Team.
- Inform the Criminal Enforcement Agency of the Provincial Police and the Provincial Police Detention Center about prisoners who are appealing through supervisory review or retrial procedures in a way that increases their criminal liability.
Provincial People's Procuracy:
- Supervise the preparation of pardon application files and the implementation of pardon decisions in accordance with Clause 2, Article 30 of the Law on Pardons.
- Coordinate with the Provincial People's Court to identify prisoners who have filed appeals under supervisory review or retrial procedures with a view to increasing their criminal liability, and promptly notify the Provincial Police Criminal Enforcement Agency and the Provincial Police Detention Center.
- Exercise the right to request and make recommendations when supervising the preparation of pardon application files and the implementation of pardon decisions; supervise the handling of complaints as prescribed in Article 37 of the Law on Pardons.
Provincial Civil Enforcement Department:
Directing, guiding, and urging the Civil Enforcement Sub-departments to implement the provisions of Clause 1, Article 31 of the Amnesty Law; coordinating with relevant units to implement the provisions of the Amnesty Law and the President's Decision on amnesty in 2025.
Social Policy Bank, Nghe An Province Branch:
Continue to effectively implement Plan No. 860/KH-UBND dated November 14, 2023, of the Provincial People's Committee on the implementation of Decision No. 22/2023/QĐ-TTg dated August 17, 2023, of the Prime Minister on credit for people who have completed their prison sentences; advise on the use of local budget funds entrusted through the Social Policy Bank to provide loans to people who have completed their prison sentences as stipulated in Decision No. 22/2023/QĐ-TTg.

Department of Internal Affairs:
- Preside over and coordinate with relevant agencies and social organizations to effectively implement Government Decree No. 49/2020/ND-CP dated April 17, 2020, detailing the implementation of the Law on Execution of Criminal Sentences regarding community reintegration; pay attention to receiving and assisting pardoned individuals with particularly difficult circumstances in accessing loans, creating jobs, stabilizing their lives, reintegrating into the community, and preventing recidivism and violations of the law.
- Coordinate the provision of all necessary certificates, confirmations, and information and documents related to the person being considered for a pardon.
Health service:
Instruct hospitals and medical centers to conduct examinations and provide relevant medical documents for prisoners eligible for pardons, in accordance with regulations.
People's Committees of districts and cities,town.
- Directing the provision of information and documents related to the personal details; issuing certificates and confirmations regarding family circumstances or other necessary documents for the person recommended for amnesty.
- Directing the assignment of specific tasks to the People's Committees of communes, wards, and towns; and to local departments, agencies, and social organizations to effectively implement Government Decree No. 49/2020/ND-CP dated April 17, 2020, detailing the implementation of the Law on Execution of Criminal Sentences regarding community reintegration, and Prime Minister's Decision No. 22/2023/QD-TTg dated August 17, 2023, on credit for persons who have completed their prison sentences.
The Provincial People's Committee also requested:The Provincial Fatherland Front Committee coordinates with relevant agencies (Department of Culture, Sports and Tourism, Nghe An Newspaper, Nghe An Radio and Television Station, etc.):To disseminate and publicize the policy on amnesty in 2025; to direct and coordinate with localities to continue educating and assisting those granted amnesty to reintegrate into the community, create jobs, stabilize their lives, and become useful members of society, and prevent recidivism. To monitor the activities of competent agencies, organizations, and individuals in implementing the amnesty in 2025 in accordance with the law.
ButRelevant departments and agencies should coordinate effectively based on their functions and responsibilities to implement the amnesty program and ensure the successful reintegration of those granted amnesty into the community.
According to the plan of the Provincial People's Committee, on May 1, 2025, the release of those granted amnesty under the President's Decision will be organized.
