Measures to prevent acts of obstructing and resisting law enforcement officers
Mr. Nguyen Dinh Hoa, residing in Thanh Chuong district, asked: When road traffic participants do not comply with requests for inspection and control, or obstruct or resist law enforcement officers, what measures can law enforcement officers take?

-According to Article 73 of the Law on Road Traffic Order and Safety: When a road traffic participant does not comply with the request for inspection or control, or obstructs or resists a person performing official duties, the person performing official duties shall take the following measures:
a) Explain to the violator clearly about the act of not complying with the request for inspection and control, the act of obstructing or resisting the person performing official duties; the rights and responsibilities of the violator; persuade and request the violator to immediately stop the violation and comply with the request for inspection and control.

b) Apply preventive measures as prescribed by law in case the violator obstructs or fails to comply with the request for inspection and control of the person performing official duties;
c) In case the violator commits an act of resisting a person performing official duties, depending on the situation, nature and level of danger of the act, the person performing official duties may use force, support tools or weapons according to the provisions of law to prevent the violation and to defend themselves.
- In case the driver of a vehicle participating in road traffic does not comply with the signal or command to stop the vehicle and flees, the person on duty has the right to pursue to prevent and handle the violation.
