Violating the field of water resources, Hanoi Textile and Garment Corporation Branch - Nam Dan Garment Factory was fined more than 61 million VND
The People's Committee of Kim Lien Commune (Nghe An) has fined the Hanoi Textile and Garment Corporation - Nam Dan Garment Factory Branch more than 61 million VND for illegal exploitation and use of underground water.
Department of Agriculture and Environmenthas Official Dispatch No. 4900/SNNMT-KS dated July 3, 2025 "On administrative sanctions for violations of the law on water resources" sent to the People's Committee of Kim Lien commune.
Here, the Department of Agriculture and Environment informed the People's Committee of Kim Lien commune about receiving the application for a license to exploit underground water of the Hanoi Textile and Garment Corporation Branch for Nam Dan Garment Factory at Nam Giang Industrial Cluster, Kim Lien commune.
Through document appraisal, the Department of Agriculture and Environment found that License No. 67/GP- STNMT.NBHĐ dated August 9, 2019 of the Department of Natural Resources and Environment (old) issued to the Branch of Hanoi Textile and Garment Joint Stock Corporation - Nam Dan Garment Factory with the largest exploitation flow of 105m3/day and night has expired; the application for a license to exploit underground water in the coming time has a maximum flow of 105m3/day and night.
To prevent revenue loss, waste, resource leakage, and prevent fraudulent and illegal acts in the field of water resources, the Department of Agriculture and Environment considers it necessary to clarify the exploitation and use of water resources of the Hanoi Textile and Garment Corporation Branch - Nam Dan Garment Factory.
Therefore, the Department of Agriculture and Environment requested the People's Committee of Kim Lien commune to "verify and clarify the water resource exploitation activities of the Hanoi Textile and Garment Joint Stock Corporation Branch - Nam Dan Garment Factory in the past time and impose administrative sanctions according to the provisions of Decree No. 36/2020/ND-CP dated March 24, 2020 and Decree No. 04/2022/ND-CP dated January 6, 2022 of the Government".
Implementing the request of the Department of Agriculture and Environment, on July 17, 2025, the People's Committee of Kim Lien commune inspected the water resource exploitation activities of the Hanoi Textile and Garment Joint Stock Corporation Branch - Nam Dan Garment Factory.
Through inspection, it was determined that the Branch of Hanoi Textile and Garment Joint Stock Corporation - Nam Dan Garment Factory had exploited and used underground water for production, business and service activities with a flow rate of 100m3/day, night to under 200m3/day and night but without the license specified in Clause 6, Article 9, Decree No. 36/2020/ND-CP dated March 24, 2020 of the Government.
In response to this violation, the People's Committee of Kim Lien commune has drawn up a Record of Administrative Violation No. 01/BB-VPHC on the field of Water Resources against the Branch of Hanoi Textile and Garment Joint Stock Corporation - Nam Dan Garment Factory.
On July 22, 2025, the People's Committee of Kim Lien commune issued Decision No. 456/QD-UBND on administrative sanctions in the field of water resources against the Branch of Hanoi Textile and Garment Joint Stock Corporation.
Decision No. 456/QD-UBND of the People's Committee of Kim Lien Commune clearly stated that the Branch of Hanoi Textile and Garment Joint Stock Corporation had exploited and used underground water for production and business activities with a flow rate of 100m3/day and night; violating the provisions at Point a, Clause 6, and Clause 15, Article 9, Decree 36/2020/ND-CP dated November 19, 2019 on administrative sanctions in the field of Water Resources and Minerals.
For this violation, the Hanoi Textile and Garment Corporation Branch was fined a total of 61.2 million VND (main penalty of 60 million VND; forced to return the illegal profits gained from the violation determined to be 1.2 million VND).
At the same time, the People's Committee of Kim Lien commune requested the Hanoi Textile and Garment Corporation Branch to stop exploiting and using underground water for production and business activities at Nam Dan Garment Factory.
