The Ministry of Justice recently published the assessment report on the draft Resolution of the Standing Committee of the National Assembly guiding the determination of the projected structure, composition, and allocation of the number of people nominated to run for election as representatives to the People's Councils at all levels for the 2026-2031 term.
Regarding the number of People's Council representatives at all levels, the draft resolution stipulates that the number of People's Council representatives to be elected in each administrative unit will be determined based on the provisions of the Law on Organization of Local Government. In addition, it will also be based on the population of each administrative unit (determined according to population statistics in the National Population Database as of September 30).
Regarding the number of full-time members of the People's Council, the draft resolution states that at the provincial level, the People's Council leadership may have a maximum of 2 full-time members, including no more than 2 vice-chairpersons. Each committee of the People's Council shall have 3-4 full-time members, including no more than 2 vice-chairpersons, and 1 full-time member.
The number of full-time members of the Hanoi City People's Council, the number of vice-chairpersons of the People's Council, and the number of deputy heads of committees of the Hanoi City People's Council shall comply with the provisions of the Law on the Capital City.

At the commune level, the People's Council has one vice-chairman; each committee has one deputy head.
Regarding the number of vice-chairpersons and vice-heads of the People's Council at the provincial and commune levels for the 2026-2031 term in administrative units at the provincial and commune levels undergoing consolidation and merger in 2025: The number of vice-chairpersons and vice-heads of the People's Council at the provincial and commune levels for the 2026-2031 term will remain the same as when the consolidation and merger took place; after 5 years, the number will be in accordance with the regulations of the competent authority.

The draft resolution clearly states that, based on the number of elected People's Council representatives and the principle of ensuring a surplus when compiling the list of candidates for People's Council representatives as stipulated in the Law on Election of National Assembly and People's Council Representatives, the Standing Committee of the People's Council at all levels, after reaching a consensus with the Standing Committee of the Vietnam Fatherland Front and the People's Committee at the same level, will specifically propose the structure, composition, and allocation of the number of people from political organizations, socio-political organizations, social organizations, people's armed forces units, state agencies at their level, lower-level administrative units (for the provincial level), villages and residential areas (for the commune level), public service units, and economic organizations in the area to be nominated as candidates for People's Council representatives in their respective administrative units.
The planning of the structure, composition, and allocation of the number of candidates nominated for election to the People's Council in each administrative unit must ensure democracy, fairness, objectivity, and transparency; prioritizing quality and selecting representatives who are exemplary in intellect, character, ethics, prestige, and who are truly clean and strong.
Simultaneously, ensure a rational structure within political organizations, socio-political organizations, social organizations, people's armed forces units, state agencies at their respective levels and lower-level administrative units (for the provincial level), villages and residential areas (for the commune level); public service units and economic organizations in the area; with representation of various social groups, professions, religions, and age ranges.
Ensure a reasonable proportion of ethnic minority individuals in the official list of candidates for the People's Council, in accordance with the demographic characteristics of each locality, and strive to achieve a satisfactory election rate.
The proportion of female delegates on the official list of candidates must be at least 35%; the goal is to achieve an election success rate of approximately 30% at each level (provincial and commune levels).
The goal is to ensure that delegates who are not Party members account for at least 10% at each level (provincial and commune levels).
The goal is to have at least 15% of young delegates (under 40 years old) at each level (provincial and commune levels).

When nominating candidates for People's Councils at all levels, local authorities must ensure that candidates meet the required standards while also selecting representatives who are exemplary in terms of gender, ethnicity, youth, etc.
