Is a 15-day public notice period required when issuing a land ownership certificate for the first time?

I own a plot of land that I have been using since 1990. Now I need to obtain a land title certificate for the first time. Will I be required to post a 15-day public notice period starting from July 1st, 2025? And what are the fees I will have to pay for this initial issuance? This is a question from Ms. Hoang Thi Hai (Cua Lo Ward, Nghe An Province).

ReplyBased on clause d, point 1, section II, Part C, Appendix I of Decree 151/2025/ND-CP, the following is stipulated:

II. Procedures for initial registration of land and assets attached to land for individuals, residential communities, and households currently using the land.

[...]

3. The People's Committee at the commune level shall organize the implementation of the following tasks:

c) In cases where land users or owners of assets attached to the land need to certify ownership of houses or construction works that require a construction permit as stipulated in Clause 3, Article 148; Clause 3, Article 149 of the Land Law, but do not have a confirmation from the district-level construction management agency before July 1, 2025, stating that the house or construction work meets the conditions for existence according to the law on construction, the determination of the conditions for existence of the house or construction work will not be carried out. The owner of the construction work is responsible for ensuring the conditions for existence of the house or construction work.

d) Publicly post the confirmation information according to Form No. 17 issued with this Decree at the headquarters of the People's Committee of the commune or residential area where the land and assets attached to the land are located for 15 days, and at the same time consider and resolve any feedback on the publicly posted information (if any).

Based on the above, it can be seen that when carrying out the procedure for issuing a land ownership certificate for the first time at the Commune People's Committee, it is mandatory to publicly post the information for 15 days at the Commune People's Committee headquarters and in the residential area where the land is located. During this time, the Commune People's Committee is also responsible for receiving, considering, and resolving any feedback (if any).

What types of fees and charges do people have to pay when applying for a land ownership certificate?

1. Land use fee

According to Clause 44, Article 3 of the 2024 Land Law, land use fees are the amount of money that land users must pay to the State when they are allocated land with payment, permitted to change the land use purpose, or in other cases where payment is required by law. Depending on each case, the land use fee when carrying out the procedure for the first issuance of a land title certificate will be determined according to Decree 103/2024/ND-CP.

2. Registration fee

According to Article 4 of Decree 10/2022/ND-CP, organizations and individuals owning assets subject to registration fees as stipulated in Article 3 of Decree 10/2022/ND-CP must pay registration fees when registering ownership or usage rights with competent state agencies, except for cases exempted from registration fees as stipulated in Article 10 of Decree 10/2022/ND-CP.

3. Certificate issuance fee

According to Clause 5, Article 3 of Circular 85/2019/TT-BTC, the fee for issuing certificates is decided by the Provincial People's Council, therefore the fee may vary from province to province.

4. Application processing fee

Based on Point I, Clause 1, Article 5 of Circular 85/2019/TT-BTC (amended and supplemented by Point b, Clause 3, Article 1 of Circular 106/2021/TT-BTC), the fee for appraising land use right certificate applications is a charge for appraising the application files and the necessary and sufficient conditions to ensure the issuance of land use right certificates, house ownership certificates, and certificates of ownership of assets attached to land (including initial issuance, new issuance, exchange, re-issuance of certificates, and certification of changes in issued certificates) as prescribed by law.

Based on the size of the land plot, the complexity of each type of document, the purpose of land use, and the specific conditions of the locality, the fee level will be determined for each case.
