Is it necessary to post for 15 days when issuing the red book for the first time?

I have a plot of land that I have used since 1990. Now I need to issue a red book for the first time. Do I have to post it for 15 days from July 1, 2025? And what are the fees for issuing the book for the first time? The concern of Ms. Hoang Thi Hai (Cua Lo ward, Nghe An).

Reply: Pursuant to Section d, Point 1, Clause II, Section C, Part V, Appendix I of Decree 151/2025/ND-CP, it is stipulated as follows:

II. Procedures for first-time registration of land and assets attached to land for individuals, communities, and households using land

[...]

3. The People's Committee at the commune level organizes the implementation of the following tasks:

c) In case the land user or owner of property attached to land needs to certify the ownership of a house or construction work that is subject to a construction permit as prescribed in Clause 3, Article 148; Clause 3, Article 149 of the Land Law without a certificate from the competent authority for construction management at the district level before July 1, 2025 on the eligibility of the house or construction work to exist according to the provisions of the law on construction, the determination of eligibility of the house or construction work to exist shall not be carried out. The owner of the work shall be responsible for the eligibility of the house or construction work to exist.

d) Publicly post the confirmation contents according to Form No. 17 issued with this Decree at the headquarters of the People's Committee at the commune level and residential areas where the land and assets attached to the land are located for 15 days, and at the same time consider and resolve comments on the publicly posted contents (if any).

Based on the above basis, it can be seen that when carrying out the procedure for issuing the red book for the first time at the People's Committee of the commune, it is mandatory to publicly post the notice within 15 days at the headquarters of the People's Committee of the commune and the residential area where the land is located. During this time, the People's Committee of the commune is also responsible for receiving, reviewing and resolving any feedback (if any).

When making a red book, what fees and charges do people have to pay?

1. Land use fee

Pursuant to Clause 44, Article 3 of the 2024 Land Law, land use fees are the amount of money that land users must pay to the State when they are allocated land with fees, are allowed to change land use purposes, or are subject to payment in accordance with the law. Depending on each case, the land use fees when carrying out the procedure for first issuance of a certificate will be determined according to Decree 103/2024/ND-CP.

2. Registration fee

Pursuant to Article 4, Decree 10/2022/ND-CP, organizations and individuals with assets subject to registration fees as prescribed in Article 3, Decree 10/2022/ND-CP must pay registration fees when registering ownership and usage rights with competent state agencies, except for cases subject to registration fee exemption as prescribed in Article 10, Decree 10/2022/ND-CP.

3. Certificate issuance fee

Pursuant to Clause 5, Article 3, Circular 85/2019/TT-BTC, the certificate issuance fee is decided by the Provincial People's Council, so the collection rate for each province or city may be different.

4. Application appraisal fee

Pursuant to Point I, Clause 1, Article 5, Circular 85/2019/TT-BTC (amended and supplemented by Point b, Clause 3, Article 1, Circular 106/2021/TT-BTC) stipulating that the fee for appraising dossiers for granting land use right certificates is the collection for dossier appraisal work, the necessary and sufficient conditions to ensure the issuance of certificates of land use rights, house ownership rights and assets attached to land (including first issuance, new issuance, exchange, re-issuance of certificates and certification of changes to issued certificates) according to the provisions of law.

Based on the area scale of the land plot, the complexity of each type of file, the purpose of land use and specific local conditions to determine the fee level for each case.
