Conflict broke out, 1 person died, 2 teenagers went to jail
From a small conflict between two groups of young people in two villages, one person died and two teenagers had to pay the price with prison sentences for their impulsive and reckless behavior.
On October 27, the People's Court of Nghe An province opened an appeal trial of two defendants, Bien Van H. (born 2007), residing in Kim Lien commune, and Dau Dinh T. (born 2006), residing in Dai Hue commune, Nghe An, for the crime of "Intentionally causing injury".
According to the case file, at around 9:00 p.m. on June 7, 2023, while on his way out, Bien Van H. met a group of young men residing in Xuan Lam commune, Nam Dan (old), including Phan Huu Khang and Nguyen Van Tinh (born in 2006, the victim's name has been changed).
Because there ispre-existing conflictsSo when he saw H. passing by, Khang shouted for his group to chase him. Seeing H. being chased and beaten, his friend quickly ran back to the stone factory to tell Dau Dinh T. and Dau Dinh Luc (owner of the stone factory where H. worked).
A while later, knowing that a group of young people from the neighboring commune was at the lemon tea shop, H. invited T. to come along. Luc also drove his car there. When they arrived, H. took two iron pipes from the trunk of Luc's car and gave them to T. and ran into the tea shop. Seeing that, the group of young people from Xuan Lam commune ran away.
T. and H. returned to the stone workshop to work, then went to look for the group of opponents but could not find them so they both returned to the stone workshop to work. At about 10:40 p.m., they continued to look for the group of young people from the neighboring commune.
After a while of searching, H. discovered Nguyen Van Tinh hiding with his feet exposed, so he called out to T. “I found him, come here.” As soon as he finished speaking, H. used an iron pipe to hit Tinh, causing the victim to fall to the ground.
Hearing his friends shouting, T. ran over and checked to see that Mr. Tinh had a bleeding nose and sand in his mouth. Panicked, T. called Mr. Luc to report the incident.
Mr. Luc - the owner of the stone factory ran to take the victim to the commune health station for examination and was allowed to go home because no injuries were found.
In the early morning of June 8, 2023, Mr. Tinh had a headache and his family took him to the hospital for emergency treatment. After a period of treatment, on June 14, 2023, the victim died. Authorities determined the cause of death to be a fractured skull, cerebral hemorrhage, cerebral edema, etc.
According to the investigation agency, at the time of committing the crime, Bien Van H. was 15 years, 6 months, and 24 days old. Dau Dinh T. was 17 years, 4 months, and 28 days old.
Then, the court of first instance sentenced defendant Bien Van H. to 5 years and 6 months in prison, defendant Dau Dinh T. to 2 years and 6 months in prison for the crime of "Intentionally causing injury".
The legal representative of the victim then appealed to increase the sentence for the defendant H. and consider the role of Mr. Dau Dinh Luc to try the right person for the right crime. At the appeal court, the legal representative of the victim maintained the content of the appeal.
The panel of judges determined that from the initial conflict to the time after beating Mr. Tinh, it was clear that H. had committed the act intentionally but did not expect the fatal consequences to occur. In this case, H. was the one who initiated and persuaded defendant T. to participate in the crime. Mr. Dau Dinh Luc appeared and drove Mr. Tinh to the medical station, but did not participate in the intentional injury, so there was not enough basis to convict him.
After comprehensively reviewing the case, the panel of judges rejected the appeal of the victim's representative, upholding the sentence of 5 years and 6 months in prison for defendant Bien Van H. and 2 years and 6 months in prison for Dau Dinh T.
