Handling violations of traffic safety corridors: Need fundamental and drastic solutions!

After 4 years of implementing Resolution No. 56/2016/NQ-HDND, the work of clearing violations and preventing re-encroachment of traffic safety corridors has had many positive changes and the effectiveness is increasingly clear. However, due to the fact that there are still many limitations, the Provincial People's Committee has advised and submitted to the Provincial People's Council to issue Resolution No. 27/NQ-HDND dated December 9, 2021, stipulating a number of measures to strengthen the clearing of violations and prevent re-encroachment of road and railway traffic safety corridors in Nghe An province in the period of 2022-2025. The Provincial People's Committee has issued Plan No. 36/KH-UBND dated January 20, 2022, specifying the content and implementation of Resolution No. 27/2021/NQ-HDND, requiring the mobilization of the entire political system, forces and means to focus on clearing violations and preventing re-encroachment of traffic safety corridors and urban sidewalks.

In particular, it is clearly identified that the work of clearing violations and preventing re-encroachment and managing traffic safety corridors is a key, urgent and regular task; it is one of the criteria to evaluate the capacity and level of task completion, and at the same time it is one of the bases for evaluating annual emulation titles. Any act of intervention or obstruction in the process of clearing and preventing re-encroachment of traffic safety corridors must be strictly handled according to the provisions of law. The implementation process must be carried out synchronously and uniformly, focusing on ensuring the legitimate rights of the people; ensuring absolute safety for the forces and vehicles participating in the clearance; not allowing errors to occur and complicated incidents of security and order to arise.

Implementing the plans of the Provincial People's Committee, with the theme for 2022 being "Continuing to resolve and handle violations and re-encroachment of traffic safety corridors in the province; combining with urban beautification", 21/21 districts and cities have developed plans and established Steering Committees for clearing traffic safety corridors. At the same time, they have launched campaigns to clear violations and prevent re-encroachment of traffic safety corridors in the province.

To ensure the progress and effectiveness of the task of clearing violations and preventing re-encroachment of traffic safety corridors in 2022, the Department of Transport (the unit assigned to regularly monitor and urge departments, branches and localities) issued Official Dispatch No. 1074 dated April 13, 2022 to urge the implementation of Plan No. 36 of the Provincial People's Committee. In addition, the Department has developed a budget estimate to support the clearance of traffic safety corridors for departments, branches and localities at the district level to submit to the Department of Finance for appraisal. The Department of Finance issued Official Dispatch No. 2252/STC-KH.KCHTGT dated July 8, 2022 on consulting on funding for the clearance of road, railway and sidewalk traffic safety corridors in Nghe An province in 2022.

On the side of the Provincial Traffic Safety Committee, Mr. Le Huy Chuong - Deputy Head of the Provincial Traffic Safety Committee said: The Committee has also established a survey team, working with the Traffic Safety Committee in the districts of Nam Dan, Thanh Chuong, Do Luong, Anh Son, Dien Chau, ... to grasp the results of implementing the directives of the Provincial People's Committee as well as the difficulties and shortcomings, including coordination and management of traffic corridors to propose timely solutions. After developing a plan and establishing a Steering Committee for clearing traffic corridors, localities have launched a campaign to implement the work of clearing violations and preventing re-encroachment. Initially, localities such as Thanh Chuong, Nam Dan, etc. have been recognized for their methodical implementation.

To mobilize the effective and synchronous participation of the political system, the Provincial People's Committee requires the Steering Committee for clearing violations and preventing re-encroachment of traffic safety corridors at the district level to be headed by the Chairman of the District People's Committee; the Vice Chairman of the District People's Committee in charge of the field and the Chief of the District Police as the Deputy Head. At the same time, it is necessary to specifically assign and assign responsibilities to each department, office, unit and individual under the management of each route or area. Mobilize maximum human resources, means and equipment of the district and commune levels to clear violations and prevent re-encroachment of traffic safety corridors. Install cameras at hot spots where violations and re-encroachment often occur for monitoring and supervision. The Provincial People's Committee also emphasized: The Chairman of the District People's Committee is responsible to the Provincial People's Committee and the District People's Committee for the results of the implementation.

Discussing this issue, Mr. Phan Van Tuyen - Chairman of Yen Thanh District People's Committee said: The District People's Committee has also issued Plan 158A/KH-UBND to mobilize the participation of the entire political system, especially the determination of the grassroots government with the core being the Party Committee, the district and commune authorities to direct and organize the implementation of the work of clearing violations and preventing re-encroachment. Strengthen propaganda work, raise awareness for cadres and people of all walks of life, promptly detect and prevent violations, especially new violations.

For example, after the clearance campaign, it was found that some households renting land along the main canal in the communes of Van Thanh, Lang Thanh, Phu Thanh, Hong Thanh, Tho Thanh and Do Thanh did not dismantle the construction works on the hard guardrails or did dismantle but continued to erect B40 mesh fences within the roadbed, did not demolish the walls between the hard guardrails... affecting the traffic infrastructure. On April 24, 2022, the People's Committee of Yen Thanh district issued Document No. 769/UBND.KK&HT assigning the People's Committees of related communes to coordinate with the commune police force to mobilize machinery and human resources to completely clear the site.

Or in the face of the situation where some people lack awareness to arbitrarily dismantle soft guardrails to open roads, tear off numbers on Km posts, H posts, signs on roads... along with that, on the routes along both sides of the road in communes with large forest areas, the situation of exploiting acacia trees gathered on the roadbed, road surface, digging the roadbed and slope is still happening, affecting the traffic infrastructure and traffic safety. In March 2022, the People's Committee of Yen Thanh district requested the District Police to direct forces to strengthen patrols, promptly detect and strictly handle acts of vandalism of traffic infrastructure assets according to the provisions of law. At the same time, the People's Committees of communes and towns were requested to guide people to exploit raw materials (acacia, cajuput, sugarcane) not to gather on the roadbed, roadside, road corridor to ensure traffic safety, and after harvest, the ground must be restored.

In Anh Son district, in addition to the general plan, the district also assigned the People's Committees of communes and towns to issue plans and directly direct and arrange the mobilization of human resources, equipment, and means to regularly clear violations and prevent re-encroachment of traffic safety corridors.

Villages, hamlets, and residential groups develop and supplement conventions and covenants on the management, protection, exploitation, and use of traffic safety corridors in the community. Establish working groups to visit each household and agency located along the routes to propagate and sign commitments not to illegally use traffic safety corridors.

Next, to rectify the situation of people arbitrarily holding markets, displaying goods, washing vehicles, discharging wastewater onto roads, gathering waste, dumping scrap, bamboo, meter, wood construction materials... in the wrong places; constructing works, installing and using advertising signs on road land, installing all kinds of canopies, steps violating traffic safety corridors, and harvesting rice within the traffic safety corridor, on May 16, 2022, the District People's Committee issued Document No. 849 requesting the People's Committees of communes and towns to assign responsibility for clearing violations and preventing re-encroachment of traffic safety corridors to each commune-level leader, police officer, soldier... for each route and road section in the area; regularly inspect, urge and handle those assigned tasks if they are lax in management and lack a sense of responsibility in clearing traffic safety corridors.

At the same time, it is emphasized that if the above situation continues, the Chairman of the People's Committee of communes and towns must be responsible to the Chairman of the District People's Committee.

However, according to the general assessment, due to the impact of the Covid-19 epidemic in the first months of 2022, the direction and implementation of a number of tasks to clear traffic corridors in a number of localities and units have not been focused, drastic, and effective. The campaign to clear violations of traffic safety corridors is mainly being deployed in batches and not regularly, so the clearance results are still limited, and encroachment and re-encroachment are still common (especially in urban and densely populated areas). In addition, the urging and direction of departments, branches and heads of local authorities at district and commune levels is still lacking. Funding from the provincial budget to support the clearance of traffic safety corridors for departments, branches and localities at district level is still slow and untimely.

To effectively implement Plan No. 36/KH-UBND, it is necessary to continue to synchronously and drastically implement many solutions. In particular, it is necessary to strengthen the urging and direction of departments, branches and localities at district and commune levels to mobilize and maintain forces to clear and prevent re-encroachment of traffic corridors. In parallel with strictly handling re-encroachment cases, local authorities must strengthen the dissemination of laws and "skillful mass mobilization" for people, especially households living along the road because "it is difficult to do it with the help of the people". In addition, the Provincial People's Committee also requested the Road Management Department II to direct the Road Management Sub-Department to coordinate with district and commune-level working groups to determine corridor boundaries; review, compile statistics and classify violators; participate in clearing violations on the assigned routes. Provide full records and documents related to traffic safety corridor management to the District Steering Committee. Fully supplement the "road land" and "road safety corridor" markers on managed national highways...
