Five crimes will 'disappear' from July 1st.

When the 2015 Penal Code came into effect, the crimes of intentionally violating State regulations on economic management, illegal business activities, and false reporting in economic management... ceased to exist.

Five offenses will be abolished when the 2015 Penal Code comes into effect on July 1st, including:Bandit activities (Article 83); DIllegal marriage registration (Article 149); KIllegal business activities (Article 159); CIntentionally violating State regulations on economic management causing serious consequences (Article 165); BFalse reporting in economic management (Article 167).

The application of these laws before and after the 2015 Penal Code came into effect is guided by point e, Article 1 of Resolution 109/2015/QH13 dated November 27, 2015, as follows.

For offenses stipulated in Articles 83, 149, 159, 165, and 167 of the 1999 Penal Code that occurred before 00:00 on July 1, 2016, and after that time the case is still under investigation, prosecution, or trial, the provisions of the 1999 Penal Code shall continue to be applied for handling.

In cases where the case has already been tried and a court judgment or decision has been issued, the fact that the 2015 Penal Code does not specify these five offenses cannot be used as grounds for appeal or protest.

In cases where a person has been convicted of these crimes or has completed their sentence, the corresponding provisions of criminal law documents in effect before 00:00 on July 1, 2016, shall still apply to resolve the matter.

If the case is discovered after 00:00 on July 1, 2016, no investigation, prosecution, or trial will be initiated; instead, the provisions of the 2015 Penal Code will be applied to initiate investigation, prosecution, and trial under the corresponding charges.
